    Medical exam is considered part of "intial evidence" for the I485. If your friend files without the medical report, his application will be rejected without an RFE.

    Hmmm...we realized that after reading immigration-law.com. Earlier USCIS was lenient and they used to issue RFE but it seems that since so many application will be filed in coming months, they are going to be strict and will deny the application without issuing RFE.
    Thanks for bringing out attention to it.

    If you were a donor member you could have asked IV to help you. They helped people with EAD delays by talking to USCIS.

    If you read my post, I did say I got mine in time. I do appreciate what IV does.

    I donate when I can, thanks for letting me know that I have to donate.

    I am July 6th filer and I opened a SR on Oct 6th and got my FP done (including my wife's) on Nov 23rd. I guess opening a SR is a way to expedite this FP process...

    It takes one week to get the visa stamped. I did it and went to India in August. They will schedule FP for you in a location close to you.

    I was just wondering, do you have that much paitence to start all over again. It is going to be another 10 years , if you are sent back in the line.
    I am in 9th year extension with priority date 09/2002.

    My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:

    I have Visa vailid till Jan09.

    1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.

    2.Is the Priority date transferrable if I change the employer?

    Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)

    It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.

    I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!

    Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!

    Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

    When we use AC-21 and change jobs, and when we travel out of the country on using AP while coming back , at the POE if the immigration officer asks if you are working for the same employer, and you say no, then what are the risks involved?

    . After 180 days you may leave, but you will have to find a new employer who is willing to hire you on permanent basis upon getting you GC for same/similar job as in the LC. What you do until your GC is approved (contract job with this employer or something else) is a different matter. Those employments can be on EAD, H1, temp/permanent, etc.

    What if the job i'm moving to after 180 days is hiring me permanently now itself? Do they still have to specify (in EVL for AC21) that they will hire me perm only upon getting GC?

    Hi,

    My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.

    * Can I claim them as dependants on my tax return?
    * Has anybody done this successfuly before?
    * What is the deduction amount per person/dependant?
    * What is the process? I know they will need an ITIN etc.

    You should be able to claim them as dependents in your 2007 taxes if they pass the "substantial presence" test. You can get 2 additional "exemptions" for them in your return. IRS looks to issue new ITINs only during tax filing (so when you mail your return next year, you attach their W7s with your filing). Or your parents can open a savings bank account and if they have any "income" in the US, they are entitled to an ITIN any time of the year.

    I have just applied for ITINs for my parents who spend 6 months every year with me. They pass the substantial presence test and I plan to file amended returns as soon as I obtain their ITINs. Hope this helps. Good luck!

    Regarding point 1):

    Note that DoS has not wasted visa numbers after 2006. For all practical purposes, days of visa number wastage is history. Why do you think the July 2007 fiasco happened ?

Unfortunately, this is not correct. While it is not possible to predict the content or effective date of any future regulations, they will likely apply at the time of adjudicating the I-485 application, and not just when the job change occurs. In a hypothetical example, if new regulations were to limit the percentage of acceptable salary difference, or prevent multiple portings, the officer adjudicating the I-485 could decide that the job change violates the regulations, even if the change occurred months or years before the new regulations were issued."

    hi,
    where is the format and what words to use and to whom we have to address. i am not on IV website all thru the day, so, i am missing the great chunk of information by evening i log in. can anyone guide me thru the process, i am willing to hand written the letter. i have seen several threads on this admin fix / letters campaign; but to be honest, i could not find anything than asking members to write letters.

    Such a loss of talent and skill should be pointed out publicly by the employers and research institutions, rather than us. They primarily will stand to gain more, then this great country and last we mortals. What do you say?

    Employers are not going to have a holistic view: all they would know is what is happening with their workforce. It is upto us to gather the big picture and impress upon Congress the widespread nature of the problem. From the prespective of an individual employer, a turnover of a few people every year (because of backlogs) does not seem too bad. But if a significant fraction of employers are facing the same situation then the problem is much more serious.
