We can keep blaming Mr. Durbin this, Mr. Durbin that. He won't change his views unless we motivate him to.
IV members in Illinois need to approach Mr. Durbin in good numbers and motivate him to change his position. Why do you guys think he's sympathetic to "undocumented"? They approach him everyday with their issues. He knows there are a whole "lot" of them in his constituency. He has a vested interest in seeing they become citizens, so that his future political career is strengthened.
Let's say 400-500 H1B GC applicants [ There should be thousands living in IL] approach Mr. Durbin - TOGETHER as IV members ; he will definitely listen. If that's followed by thousands writing regularly to him; he will surely do whatever he can do to accomodate "future voters" in his constituency - be it dropping some of the more draconian measures, softening his opposition to SKIL etc.
Right now, it's just 'Programmers Guild' , and other like minded labor unions, that have been talking to Mr. Durbin. They have probably been approaching him in greater numbers, through lobbyists, even making campaign contributions [ which we can't do].
There's also this wrong image in the minds of Democrats, especially those with labor backgrounds, that Highly Skilled Immigrants tend to lean "Republican". This also needs to be kept in mind while approaching Senators like Mr. Durbin. If I were to talk to him, this is what I would say
1) Foreign workers do not depress wages. Insufficient Visa numbers, the flawed GC process that takes years to complete and forces workers to remain with same company at the same position in a resricted salary range etc. keep wages depressed for Foreign workers ( as well as the whole job market). Measures that punish Foreign workers for the flawed Immigration laws is like throwing the baby out with the bath water!
2) Right way to tackle the situation is to improve Immigration laws to make the GC process faster by increasing the numbers, transparent, tougher laws against employers/lawyers that game the system and abuse the workers, remove anti-worker provisions and provide increased job mobility to workers in changing employers, getting promoted to higher positions.
3) Need to eliminate Country quotas that promote discrimination on the basis of National Origin. There is no basis for Mexicans, Philippinos, Chinese and Indians to be forced to remain at the same position, same employer, same salary for years; just because they happened to be born in the "wrong" country by chance.
4) Commend Mr. Durbin for proposed H1B/L1B whistle-blower protections. Commend him for a pro-Immigrant DREAM act and requesting him to extend it to kids of Immigrants waiting for the GC who face dire situations due to "aging out". Also express hopes that Mr. Durbin will continue to take up legislations that benefit the whole immigrant community.
As long as there aren't enough people from Illinois, especially a H1B-rich city like Chicago, approaching Mr. Durbin and explaining our case - in the terms he understands and appreciates; there is no point in blaming Mr. Durbin to anti-H1B. If he is, it's because we have been silent and he's listening only to PG and such groups in good numbers ( while legal immigrants may have approached in smaller groups)

We have been to a doc in PA
Shots & all the test no X-Ray: $400 x 2 adults (myself and spouse).
Did this in a hurry to facilitate attorney to send I-485 and deliver to USCIS on July 2nd.
I saw some great deal of info and ideas from IV ers on saving few bucks with proper planning! Will keep in mind next time if needed.

Find a company that lets you work from home when your kid is sick ( I guess if you are starting a company soon...you could probably put it as an employee benefit). & find a daycare thats reasonably flexible.

Are I-140s also getting denied for consulting reasons? I have an amended I-140 pending (company merger issue). I work for a fairly large consulting firm for the last 8 years and always have been with the same client(fortune 10). My H1B is valid till Nov 2009 and EAD till Sep 2010. I don't intend to extend my H1B at all but I'm worried if this new CIS stance might also apply/affect I-140s. Anyone seen I-140s getting denied for consulting reasons...

They of course have to apply in the same way anyone would and have to find a way to pay the tuition fees and board if applicable. It might be more difficult in some locations than others to get in state fees without a green card but you have to work on that matter with the institution in question. One more thing without green card in hand you are not entitled to any federal assistance, student loans etc. Majority of scholarships require green card too.
So what you are saying is that kids (<21 or >21 years) who are in I-485 status can go to college with the same status....work with institutions if they have any issues .. financial sorta.. but should not be having any legal status issues. understand.

When anyone violates the status IO has authority to send him back. Bench without pay is one of immigration violation. IV or lawyer cannot do anything about this. But when all are correct and still if a person is sent out then that needs to be defended.

The information provided by IV based on FOIA does not seems to be correct.
The web page which calculates the prediction has a problem.
For Dec 2007 priority date for EB3 India, it says that your position is 8920.
As per USCIS, there are close to 70,000 I485 pending for EB3 india. How is that it is showing some where close to 9000 in FOIA?

1. They had to post the 485 pending list sooner than they anticipated because USCIS "one up"ped them by posting the info on their website and hence they were not able to play "God" with that info anymore.
2. They got my ID and IP banned but still I came back.

Yeah, the situation is bad. We did testify on Bill 962. But, that bill creates problems of its own. It will not be going anywhere.
If you want to write to someone write to Governor Granholm. A similar issue was fixed in TN by its Governor through Executive Order. Surely, Granholm can do that in MI too. We have a letters campaign on this.

it looks like what we got off FOIA is just numbers of I-485 applications that are yet to be looked at, in other words - not pre-adjudicated!
The pending inventory report of USCIS look like the real numbers!
I do not want to create any pessimism here but things will be clear(er) in coming months depending on the visa movement.
For any reason if the FOIA numbers are true, from bottom of my heart I HOPE that they are true, we shall all get lucky pretty soon...if not...we need to hold USCIS accountable sue-or-not-sue!

This bill is nicely written but lacks a lot of specifics; granted that it is just a draft.
It looks like it is written only for the Public.
Almost everyone has pointed out good things about the bill (Including IV admin who has nicely put together the summary of good provisions); I thought I will be devil's advocate and show some negatives (I am purposefully not mentioning positives; I am well aware of those..:))
The bill calls for "securing borders first"; literally creating a "human wall"; cost of which will be prohibitive. I dont know how they will justify this.
Additionally, it does nothing to the current "cap" on employment based immigration (which is the main problem; and if not addressed worse situation will arise in future).
Another catch is "what will happen after 8 years"? This is not very clear. They are claiming to "clear current backlog in 8 years" (which may be doable if they eliminate per country limit); and then without any country limit they will allow 11 million illegals to file employment based greencard! That will by itself will choke system for 50+ years :) (no change in total quota)
Also there is no mention of the system that will be used to provide "LPI status" to illegals; current USCIS resources would not be even closely sufficient to do this in next 8 years.
Also the "commission" that will overlook this; sounds to me like a "czar" system of democrates; There is overlooking systems currently (like Ombudsman); but it is just for the "show". I dont know what exactly they want to accomplish by this "commission".
In short; there are many shortfalls of this proposal; but the positive aspects are very bright as well; this bill hopefully will end agony of all of us and also hopefully they will address above shortfalls before being enacted.
And above all: I HOPE ALL PROVISIONS FOR LEGAL IMMIGRANTS WILL NOT BE STRIPPED IN THE CONGRESS!

is there an advantage of applying for ead and ap? my wife and i got our h1s stamped in may and they are valid till 2010. so ap is not required...however if either of us wants to change jobs in a few months...ead will help. my q is this..can i apply at that time in the future? no need of clogging up the lines now. what say???
also for medicals.. do we wait to hear back from the lawyer with the forms or can we schedule this on our own?
can anyone reccomend a good civil surgeon in the atl metro area?
