I second what TheOmbudsman is saying. The deal breaker shouldn't look like a huge legal immigration overhaul. Instead it should look like a stop gap measure to solve shortages of Skilled workers( 14 months H1B blackout),
Nurses (imminent retrogression in Oct/Nov) and a relief from retrogression.
It might not fix everything but it will still solve some issues we are facing. If we ask a lot it will all end up like CIR. The question is how to get relief from retrogression without overhauling the process. May be increasing visa numbers to account for 245(i) amnesty. This way it will look like the law breakers are not rewarded at the expense of us, the legal folks.

It doesnt affect me, but I'm willing to support any effort in this and I'm sure this is a very very genuine case and will get approval from any law maker who is supporting DREAM,
IV Core, we need your help in this. Can you please come up with an action plan. We are willing to fund the cause if you come up with how we go about this. We know its not just money thats needed but a campaign type effort and I'm sure all the parents and their kids will come out in support. Too bad that these kids have to now suffer..

Yabadaba just because someone wants to stay at home with their kids does not make it an excuse. Besides who appointed you or me King to pass judgement on that issue? I know some american citizens who do that as both parents believe that a non working mother is essential for children growing up, who can take care of their needs.
Also what about those H1's and H4s that have been here for a while, but have NOT been able to take advantage of the July 2nd filing?

If someone does not have a NRE or NRO account, just a simple savings and Checkings account with FD (Called CD's here) ---------- All of this is in GOVT owned Banks, Like SBI, Punjab national bank, Vijaya Bank etc.
Before coming to US the sum of money in all these accounts and FD's (Fixed Deposits) was less than $10K. {Principle + interest}
Now after we came here we funded these accounts with money sent from US (TAX PAID MONEY WAS SENT FROM US BANK ACCOUNTS).
Also the interest which we get on these Accounts annually do not exceed $10K............... I believe that they should not look into the Principle amount (since this was already a tax paid money)
Apart from this no other source of income is there in India.
Do we still need to file this form ??

My post was to raise the awareness. As long as we are aware of the repercussions of the clause and plan to tackle it, it must be OK.
But, in all honesty, no matter how much we trumpet about the other provisions, if this clause gets in in it's current format, we could be in trouble.

Guess we have to wait and c, some one told me that they have to finish issuing all EADs by 20th of this month, so hopefully something will happen soon. Every one please update if there are any changes in your case. Most of my friends who applied after me did get the EAD and I am a bit worried that there are just few of us with not even the checks cashed :(:(:(

Wonder if things have gotten better or worse in California. I remember H4 being denied DL or even a state ID years back.
Did H4 have SSN? I never heard any problem from anybody who I know with state id. People were getting it without SSN and even with expired I-94s. I helped a few people to get DLs (drove them and translated), mainly DMV was asking for SSN. If you don't have SSN, then unexpired I-94. I renewed mine few years ago and honestly I don't even remember talking/mentioning about my immigration status.

guys..dont be too much happy about the EB2 ..the TSC actual processing dates are April 2006 and not July 2007 as shown on processing dates website..i checked with USCIS customer service and they mentioned that the dates shown on USCIS website are not current. The USCIS customer reps have the current dates of processing and that is April 2006....
If that is true then it shows how the 2 Deptts have no clue waht the other is doing...DOS makes EB2 India Jun 06....while they are still processing Apr 06.....that is awesome.

Worst case scenario, senate will pass this bill, the house will pass this bill, the president will sign it and then someone from the USCIS will come by and tell em you're a bunch of jackasses, are you effing kidding me, you people are so goddamned detached from reality, go back to your rooms and come up with a better pile of horseshit than this, your time starts now.

B) After 5-10 years, they'll see the net effect. Guess what, if you don't work here, you don't pay income tax to US or State of california; You pay it to India or China or Canada or wherever you end up going.
C) Besides, it drives up income for whoever is left here (US citizens who know how to do our job, chances are that they already have a good job right today). Why do you think IEEE supports the new limitations on H1B numbers and Employee based immigrant visas? Like what Don Corleone said in God father, "It is just business."
D) (C) would make it harder for US companies to compete with their Indian/Chinese counterparts, and they'd pay less taxes to US too.
E) Remember, the school system in US is very broken. in late 90's there was a high demand for experienced hi tech workers and they had to look in india and china and elsewhere for them. They did not fix their schools, since it costs a lot of money, and pays back around 10 years later where the presidency of Bill Clinton or George W. is done, thus they can't get credit for it.
There you have it. Without the right amendments, not only US shoots us in the foot, but also shoots herself in the foot.
