All BEC fellows, prepare your 140 and 485 documents ready so that you will be able to file it anytime. Do not wait for labor approval. At the most you will lose 1K but if you could file, you will gain more.

Check out immigrationportal site. In the I-140 section , you will find some experience similar to yours. You might have to submit an educational evaluation to cofirm that what you did id equal to a 4 year degree in US. Also, the requirement in LC would be important. If it says equivalent or foreign equivalent for degree , you will have more luck. Post your question in IP site and someone who is undergoing/has undergone similar situation can guide you better.

What kind of letter you received from DOL? DId you change the address after filing your labor? I have changed it so many times but I did use AR-11 form last time to update the address when I moved to a new address. I have not received any document from DOL.
But the real question is cna you file I-140 or I-1485 based on the the doc you recd. .. probably not.
I am not sure what I can do .. I wanted to file I-140 and I-485 concurrently as suggested by my attorney (R Khanna).

The letter from DBEC says my Labor is certified. We cannot file any further paperwork until our lawyers receive original documents, namely, ETAs. Even I had changed home address last Januray. I am thankful to US Mail that they still have my address change request active in their system even though it has been more than stipulated 2 months.
I have a fair amount of confidence that your letter is lost in address change jungle. Looks like a chronic case of one entity not talking to the other, ideally we would expect filling AR-11 should do it, but unfortunately it does not.
BTW my labor was approved in EB2 TR PD = 03/05 category.

Every now and then I've seen IV arrange a Q&A with an Immigration Attorney on our forum. It would only make more sense to ask the Immigration Attorney, who have been helping us with the Q&A, on what to interprete of this memo for the huge (almost 300K huge) AOS community.
Now it is very well understood that the people on EAD (having used AC21) will be completely screwed if the interepretation of this memo holds true per everybody's understanding, though, one thing to also remember is that the people who have saved their H1Bs for now can very well be forced to utilize AC21 under drastic and unexpected circumstances....needless to say....current economy and job report is overwhelmingly worse in years and no one knows right now whose company might close off tomorrow or whose company might layoff an entire department or a regional office.
So clarification of this memo is essential for the smart H1B keepers and the foolish EAD users, equally!

I travelled outside the country for business about 24 + times in the 18 months on my H1B and some times I got I-94 for the day of H1B expiry and sometimes Expiry + 10 days. Once I got so confused and I politely asked the CBP officer why is it so and I was told that every person on H1B has the right to have their I-94 for extra 10 days from expiry since its the time alloted for them to pack up and leave the contry incase they are not planing to extend their H1B after expiry.
They also said if any officer forget to do it, then make sure you ask them to throw in those extra days. So you have a right to have your I-94 to expire 10 days after H1B approval expiry.

According to IRS web site, if you are H1B holder and your wife and children on H4, you will not get a single dime. Unless you don't file joint tax returns.
This is what I have been feared all the time, that some day we will be treated equally as illegal immgrants.
Where is this mentioned???? If your wife has H4 but she has a valid SSN, I suppose u would be able to get the stimulus???

I think you have to get your basics right. In the first place, you have to understand the evaluation process.
When some one completes there bachelors or masters in certain amount of time. It does not mean by years rather it is meant by the amount of course work they have done. Usually each course work is evaluated to 3 credit hours on a sem by sem basis.
For a bachelor�s degree, a person has to complete at least 120 credit hours which is like completing 40 courses. For a masters degree it is at least 33 credit hours.
Now coming to your point. In Professional degrees like Engg in India, every one has to complete at least 45 courses before they can be granted the degree on a year by year basis and on a sem by sem basis the number is much higher but evaluates to the same.
Just as Mr.Dilber_Cal has said, street courses do not evaluate to a degree rather they add to certain credit hours to an already existing bachelors(3 year) degree, which the evaluators(for there own benefit) are equaling it to a degree from an accredited univ.
If you want I can grant you a PhD. Can you have your GC processed in EB1 cat?

-The German Visa rules changed as of 5-Apr-10.
-The German consualte officially advises to get Transit Visa.
-But people with similar situation travelling via Frankfurt posted that Transit visa is not enforced at the German airpots.
-You need to decide if you want take the risk when travelling with your family or play it safe by getting the Transit visa before leaving from US.
This is my Story:
-Reserved my tickets via Air-India during March-10 for travel in June for myself and family.
-Travel Agency confirmed no Transit Visa is needed.
-Was checking back in May at the German Consulate website and found that they have removed the exeption clause for Adavanced Parole.
-Sent an E-mail to Boston Consulate. Here is the reply I got from them.

Having been trying to keep this thread on the front page for two days now and we still have very few people posting. It is more than evident to me that the community as a whole do not care about anything that does not help them.
I am more than happy to work on my own in the hope that somebody in the right place sees it which I will never give up on since this is for my son and would lay down my life for him.
The concept of getting a large group together is obviously completely beyond the realms of IV. However, there appear to be at least three people who are really in this situation who could work as a unit.
i aged out and yvjoshi are the other two besides me.
Let us talk at least.

there has been 3 approvals yes but these are 3 being reported on IV this is just a sample and the population must be much much larger. even if we go very very conservative on this the population should be at least 30~40 times (and I am talking more conservative than an evangelical from the bible belt) so 3 approvals which would be 3*2.2 (GC per primary)* 35 (Population estimate based on the sample) gives us 231 GC's today. now it doesn't seem so bad does it. :)

Interesting idea!!
For argument sake & extend your idea -- they should split Cities, towns and villages. Most of the GCs are consumed by people from cities & towns. If they want to TRUE diversity, they should split GCs cities/towns & villages. :)

So for GC purpose they should split India and China into states of birth as well . Just look at it Uttar Pradesh with a population of 16 crores can become 6th largest country in world on basis of population. Then we have AP, Maharashtra, Gujarat etc. That will automatically increase numbers for all of us and still keep the country limits. Plus it will in true sense bring diversity from these two countries which are right now dominated by few states both in FB and Eb categories. Please dont get angry if you dont like it. Just a wild idea which will perhaps never be implemented but food for thought
