Thanks for your kind reply. Yes this amount of 40K is what i saved from my salary after my employer deducts taxes via withholding. I am confused because I read that you have to declare any foriegn accounts help while filling for taxes here in US. I made these trasnfers to my dad's account and I dont have any NRI account. I am not sure if I will fall into this category and have to declare all this. Thanks again for your help.

LoL. The response from the senator (actually from one of his assistants, for Obama did not even read your letter), may appall you thoroughly, but it was completely expected. We may think of our predicament apocalyptic, but from the point of view of a wannabe president, it is not even a problem which requires a careful and personal reading of a letter. With huge issues like Iraq war and 12 million foreigners living illegally in the country bearing down on him, who has time for a few thousand law abiding workers waiting patiently in line.
How disheartening it can be to realize that let alone helping solve your problem, this country has not even noticed our problem on its radar. Part of our problems is actually caused by illegal immigrants, and yet we are being confused as being one of them. Somewhere in these forums I read somebody�s suggestion to rename the organization to legal-immigrants-first, or a similar sounding name. We must first clearly identify and register ourselves in the eyes of leader of this country, before letting them know of our problems.

This part refers to family benefits, i.e. payments to spouse based on your SS contributions.
The family benefits are explained on the ss website but there is no clear information about how the worker will get the benefits. On further digging, I found a document which indicates that the worker must be in the US to get the benefits.

Missed the most important show stopper, FOR ME. All my current Nikkor primes are no good for this babe. I have to buy the three latest and greatest 2.8 D AF-S ED IF (???) big zoom lenses. With the 14n, the total is $10,000, no change, not even a penny. WOW!!!

Thats a friggin mess! I hate all the confusion that exists in the Nikon line of lenses. Some camera can take some lenses others cannot and they have all the terrible suffixes. Oh so annoying. At least with Canon if it says EF you'll know it'll work with the exception of a few very old EF lenses.

What Pankaj did was great. The idea was really great - earlier we made a youtube video that is linked on IVs front page and that also has the anthem in it - when I did that I was having the same thought - whether it would be a good idea??? But then I thought, offcourse , why not???? Just because anti immigrants hate us, it does not mean we don't belong here, we very much belong here and are a part of this society.
We must all be proud that we are here - remember - we may have come from different countries but now this is our home - offocurse tough situations may prompt people to return or many may not have a sense of patriotism.

You will need to do some research regarding the legitimacy of this university. I did a quick look up and it looks the University (of Melbourne) is legit. But the logo of University as in their website and that in the degree copy which you presented are different.
The other thing that concerns me is, most legit University do not use sample copy of degree as a marketing tool.
I know how to verify the legitimacy of an US University or Indian University but not for Australia.
Having said that, if you get a 3 year post graduate degree (not diploma) from a legit non-US university (in Comp Science or something related to your job) combined with your 3 year degree should qualify for EB 2.

If you enter on AP, but have a valid H1 extension approval to xx date, and the xx date approaches and you are working for only the original H-1 employer maintaining ALL the conditions of H-1, you can request an extension of H1 status and if all is ok and it will be granted and you will get back on H1B non-immigrant status. But until such time, one is not considered in H1 non-immigrant status but "adjustee of status," which is NOT any non-immigrant status.

Should there not be a separate Green card quota for anyone with a USA Masters Degree in any field?
If USA does that, more people will pay to come to study in USA. Not go to Australia, UK etc to study. So more money to USA. And USA degree holders will be able to use this education and work in USA to improve USA economy. If they go back to their countries, then USA has brain drain.

Include as a small comment or note at the top. It is easy for any one to 'google' conference, immigration and bill to come up with a few thousand good and relevant link. If I post a good number of them, one would definitely be lost.
Posting links should serve a purpose here. The primary purpose is achieving IV goals. A smaller purpose could be to see what the other side is saying, but my suggestion is to ignore them in general.
I went to both the links; one of the I understand is a Libertarian organization and the other radical left. As anyone can see, they don't represent the views of mainstream America. So, it is a waste of time and effort and above all a distraction here. That's my advice.

it seems democrats are making this bill so liberal that even liberal republican will have tough time to support it.... in that case democrats can say republican are not in favor of immigrants and Bush is not able to manage any support from his party.... Thanks Paskal, I fully understand now with the example of the Scarlett Letter. I need to get busy and get another waiver then. Maybe I wasnt very clear on my first post about my stauts. I had had only a first J1 from 2002 to 2005. I wanted to stay so I got a waiver that time, and I tried to get a H1B, but I couldnt get it due to expired documents that I could not get renew from my country so my H1B was denied. Now some years later I decide to come back and the only fast way to come was with another visa J1. So as you explained I need to get my case number and start my process all over again. ONce I get the waiver I will look for a new sponsor and star the H1B process all over again. I cant be very open about this because if my present sponsor realizes that I am doing waiver and everything else I may loose my J1 because I signed a contrat to work for them for 3 years and then go back home. I think it is very unfair, but that is how things work around here.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

In current congress's CIR (which was very bad for all of us; fortunately for us its failed) discussions a bunch of senators argued very strongly in favor of family based immigration. It would interesting to see how these senators will react to this proposal - after all spouse is the most immediate of family and exempting them from annual work-based quota seems quite logical. But again its not about logic its all politics.

Senate just didn't have time to discuss all the amendments and provision. This issue about who will have how many amendments was a problem issue from the start. Also you need to look at the number of amendments not just the number of pages.

I am not one of the gurus who have an excellent idea about the number game! Nor am I a person who has obtained a US degree!
However, I feel that any bill which will provide more visas to the legal EB community should be supported and welcomed as this will certainly reduce the clogged line. Let us welcome and support this bill.
Again, let me add that I do not intend to support any particular group. I am only a supporter of legal immigrants!

Not an amended H1. It is an H1B extension for 3 years after I140.
The question is if you have this approval in your hand (whose start date is after your current visa validity) and you return to the country within your visa validity, will the official have I-94 valid till the end of the new approval or till the date your current visa is valid?
According to "Last Action" Rule of USCIS, there is a possibility that your H1B extention approval becomes invalid because the POE gave validity till your visa end.
Seems all so screwed up. But red-tape rules are never white and black.
