Sorry guys I am not the brightest bulb on the tree so I kinda missed the joke here. Are you saying that USCIS is giving away TVs and we should all watch TV instead of waiting for GC? Or are you suggesting that we should start selling tv to get gc?

If you clarify whether the TVs are color or black-and-white may be I will get the point?
    :confused::confused::confused:

I bought a D70 October 29th, and have terrible back focus problems. I've been a photographer since 1959, used Nikons since Vietnam in 1968, and know what I'm doing.

To test whether the back focus might be my fault somehow, I have had several friends use the camera without telling them what I was testing. All had awful back focus; not one low light, wide aperture image is anywhere near acceptable.

Clearly, this is a systemic problem with the D70. I had similarly disabling problems with my first two FEs when I bought them in about 1978; apparently Nikon still tests its products on its first year's customers. Back then, it caused me to change to Canons until I bought an N90s and came back to Nikon.

I might do the same thing again. It is very sad; I like my Nikons and we've seen a lot together, but this is the way a company drives its loyal customers away.

Just saw a soft LUD today. No status change from yesterday though.

fundo14 - how long has it been since it was transfered to the Des Moines office? Have you called and spoken to an IO about this change?

Almost a month now. Last Soft LUD was 5/20/08. nothing after that.

I applied for my H1B 9th year extension using I-140 substitution in 10th March 2008. My 8th year H1B was expired on 14th April 2008. Currently my 9th year H1B extension was is in pending status. Unfortunately my I-140 was denied on 18th April 2008 due to 4 years Bachelors degree.

I used PERM EB2 labor substitution (May 2006 PD) and filed I-140 in July 2007 and denied (NSC) directly with out RFE. This is due to 4 years bachelor's degree and I have 10+2+3(Diploma) +3 (engineering-AMIE). I already applied my 485, EAD and AP. I got AP and EAD, but didnt use it.

Now how can I get my 9th year extension?
Can I appeal for I-140 and get 9th year H1B extension?

Could you please give me your valuable suggestions on this?

    Thanks,
    Naga

Get your degrees evaluated by the certified evluators and add your experience to be qualified or you can go for EB 3 but your priority date will remain the same. A friend of mine was in the same boat, but had 3 years commerce college and 2 years MBA from UK and was in his 9th year of H1, I 140 was denied. He appealed and REAPPLIED I 140 with all the evaluations, he got approval in less than a month but EB3 with the same old priority date.

    Good Luck..

    Ramesh

Ohhh okay. I didn't notice in your OP that your passport is expiring in July 07.
Yes, in that case, you'll have to get the new passport and try again at the CBP. Good Luck.
    gcnirvana,

I guy at the CBP office said that since my passport will be expiring on July 2007, i should have gotten my I94 stamped only till July 2007 instead of till September 2007 which is whenmy visa stamp will expire ... I am planning to try my luck again once i get my new passport ...

    H1Employer -

Would my mind answering my question?
    Thanks!

Can I ask you a question? How much your corp usually pays if you are billing at $80 per hour? 55k per year or 95k per year as Salary + Benefits. (BTW - Just to make things clear, I am not looking for job as I am independent IT consultant with my own corp).

I have seen many cases where consultant is billed at 80-90 per hours and gets paid only 50 to 60k (based on his/her "negotiation" power).

In one case, this agency had two consultants at same client (one of the large banks) and were getting billed at $80 per hour. The H1-B person was getting 56k/year and green card holder was making 95k per year. This is the reason why many people want to jump for another job when they have EAD or GC.

    My 2 cents.

    Dear <newschannel /congress/senator/legislator name here>,

While the coverage that we "potential" legal immigrants received during the CIR debate was abysmal because we were not considered "human interest" pieces by journalists and editors. We have been subjected to another slap in the face by a broken immigration system.

    Please see:

    http://www.aila.org/content/default.aspx?docid=22804

"Administration Slams Door on Thousands of Legal Immigrants: AILA Condemns Agencies' Bait and Switch
Cite as "AILA InfoNet Doc. No. 07070264""

This news has so far only got brief coverage in a few websites. Among them include:-
    http://news.yahoo.com/s/ap/20070703/ap_on_go_ca_st_pe/immigration_green_cards
    http://seattlepi.nwsource.com/national/1152AP_Immigration_Green_Cards.html
    http://news.google.com/news?hl=en&ned=us&ie=UTF-8&ncl=1117797588

We hope that this press release is sufficient to now categorize us as a human interest piece. It is ironic that those crossing the borders illegally get front page coverage, while the tens of thousands of us going through the legal channels get ignored. Many of us have spent hundreds of dollars and wasted time, effort and money, only to be rudely slapped in the face by this visa bulletin revision. Any coverage will be appreciated.

    Thanks,
    <your name here>

    =====

Please send this to any newschannel, legislator, or congressman in your area. The more people know about this, the better. (Also, ensure that the yahoo and nwsource press website links are complete as IV cuts the full path from my post.)

What is Ron basing his prediction on... I am not sure the trend says so... Can anyone please share his logic?

2 months before, IV has learned from CA/VO at the State Dept that 80-85% of all the visa numbers have been allocated for the fiscal year. I am sure that the actual usage by now is probably more than the 85%. If I am not mistaken, DOS considered 95% utilization as best in the past. It seems to me that they want to get close to the 100%. If you look at the last few bulletins, the cut off dates moved by one month and not by leaps and bounds. Clearly there was demand. I can see EB-2 I & C with PD's of 2002 getting approvals. The demand for EB-2 I & C still exists. DOS just gave USCIS an opportunity to USCIS to utilize the visa numbers. We all know that there is no such thing called FIFO with CIS. I have said this before and will say again one more time.

In the last 2 months, Some one with a PD of Jan 06 might get approved and some one with Jun 02 will be sulking. Just because EB-2 I & C dates have moved to 06 for a brief time does not mean that EB-3 I & C are the only ones that will be left sulking for ever. EB-2 I & C will join the lines in no time. The comparative pain & wait time for EB-3 I & C is more, but what difference does it make if it takes 6 years vs 10 years. Any solutions or thoughts to our issues that are designed entirely on a EB category basis, IMO are not good.

yeah, you are correct we will post all our information too, like bank balance, SSN, etc.

huh ?? what's wrong with having update to date count on IV contribution and balance ? If people are funding IV , then IV can post where that money is being spent. IV is non-profit organization.. right ?

Thanks for all the responses. My question is: Can one legally be on payroll of two companies and draw salary from them, both on H1? How about both on EAD? And, one on H1, the other on EAD?

h1 is an one to one relation
EAD can be one to many
    :)

I think you are safe... just make sure you fall in the same/similar category in case there is a query.

    Good luck!

    Hi GCNirvana,

I found one of your earlier posts on this forum suggesting that 3 years back you were in the same situation as I am today - expired VISA and two extension approvals (797's). In my case, VISA expired in oct 09, current 797 expires 31 dec 09 and next (against I-140) starts jan 2010.

As your's was the only post i found on this topic, it will help me a great deal if you could let me know about your stamping experience. You mentioned that your stamp showed validity dates from both 797's, could you please share some more details on that? Did it have two start dates and end dates?

Besides, from another one of your posts, i gathered that it is best that i come back into the us only when my newer 797 is already active. i guess it wud reduce complications at POE. Would appreciate if you could give me some suggestions here too.

Well, i can already thank you for your posts as i really struggled to find information relevant to my case before i came across your posts.

    Thanks.
    ---------------------------------------------------------------------------------------
Visa Stamp in Passport: 13-Jan-2007 (I94 in passport expires on 1/13/07)
    Current I-797 : From 02/24/2006 to 04-Jun-2007
    3-Year extension based on I-140 from: 05-Jun-2007 to 04-Jun-2010

In this scenario, if I goto India, say in Feb, get my visa stamping done, what will be the validity of my visa in the passport?

    1. 05-Jun-2007 to 04-Jun-2010 as stated in my 3-yr extension or
    2. the date I went for interview till 04-Jun-2010??

If its the former, then how can I get into US during March '07 as there will be a gap in my visa dates in the passport?

I will send the same questions to my attorney but would like to know before hand, just in case, if my attorney tries to act smart :(

Thanks in advance for your responses...

My case status online does not say anything about when it was received. It just says, "This case is now pending at the office to which it was transferred.". There is so much ambiguity at USCIS that it takes tons of reading / pulling hair just to understand what they mean. They have transferred my case three times. First of all there should be a reason for it (no reason makes it you wonder why ??) , then if they keep transferring it from one center to another, does that mean that the "received date" will be changing for ever and the case will never be processed ? I think USCIS should be accountable for that.
basbawa10, Well, why they are transfering your case back and forth can only be explained by them. Very fact that your case has been transfered around suggests that somebody has seen your case. Procedures described in link mentioned above, has a protocol on determining proper processing center, which has a complex formula based on state of residence, center approving I-140 etc. If your I-140 was approved by one center, and if in the meantime you moved to a state in different center jurisdiction, or USCIS changed jurisdictions, it might have created ambiguity on who should deal your case. Back and forth transfer suggests that centers are not agreeing on who should deal with your case. You may want to try an Infopass, which would let you know if your case is preadjudicated. If so, you just need to wait for PD to be current again.
