Perfect! many thanks for posting that link. it looks like our dear HR5882 is light years away from being signed into law... so I just tamed my expectations... However, we definitely need to keep up those phone calls. Fair Disclosure: I have called only once or twice... Folks, I am very less motivated about this thing getting better. Good Afternoon IV members,
Best wishes to all of you who are seeking advice or are in a visa process of any sort.
My question here if any one could kindly help me: I came to work in 2002 with a J1 visa, stayed for the 3 stipulated years under the J1 visa. I wanted to changed my visa for a H1B so I got a waiver, and then I went through the process the year that they had the lottery for H1B, I made the lottery, but sadly after paying all my fees, sending all the documents that my lawyer asked my employer for that time, I did not obtain an H1B.
Last year I could come back with another J1, I stayed in my country for 3 years, so my new employer applied for a J1 without using my waiver, as there was not need for it. Now my question, I do want to change my status from my present J1 to an H1B, and I would like to know if I can use the previous waiver that I obtain with my first J1 in order to waive the 2 year residency restriction on my present J1 so that I could apply for the H1B with a new employer?
Any advice is greatly appreciated.

Another helpful "negative feedback" is the trend of GC applicants stuck in the system moving out of the US. Understandably, most immigrant are reluctant to take this tough step but the trend is here and it grows like a snowball.

Maybe the IV team, when interacting with legislators, can also highlight cases of exceptional persons who got tired of waiting for their green card and are now productively employed in their home country. That will be a nice complement to the stories of people like us who have still not given up.

Most audits are routine, once you can back up your claims with paper records/receipts you will be OK, but consult with your CPA and be ready to address the points raised.
Unless you have been found to commit criminal fraud, it should not affect your green card petition. Small penalties and the like have no effect. Last year I had to pay a small penalty because I underestimated my taxes deducted during the year.
You are getting an audit for the 2005 year now? I would have thought they would have moved on by now. Did you take an extension and file late last year?
You can expect it anytime. The retention period is 7 years, so keep all your tax filing papers and all related docs for at least 7 years.

Now you will see this thread die down as people who were complaining will simple stop posting in this thread and as always, our brother in arms will not participate by calling lawmakers. It seems that they are scared as if as soon as they would dial the lawmaker�s phone number, the cops standing outside their office will simple arrest them to deport before tonight. People, open your eye, we are in AMERICA. This is Democracy, you are expected to tell the lawmakers about your definition of fairness and how you have been treated unfairly. It is our responsibility to tell lawmakers about what is �unfair�. 100+435 men/women in DC want to listen, the only problem is we don't want to speak to them. Most of our fellow forum members think that simply whining on the forums will make the problem go away.

Given a choice (with comparable role and growth) I will be more inclined to spend few years (~5) in Europe, post MBA.
Was just trying to make sure if there was a easier way to maintain my GC, at the same time complete my studies in parallel.
Per all your suggestions, there are ways to walk that tightrope, but its not very straight forward...Also I am not looking into deferring my studies for a year..
Will go ahead with resignation...

This process is somewhat new. Random selection of application for a face to face interview. Be normal but prepare for it. Have all documents ready before the interview and if your company can provide you with a lawyer have the lawyer go with you.
My case is EB2 PD Nov 06 and 485 filed on Jul 2 2007. I-140 already approved. I went it for interview and was asked several routine questions. I was told by Immigration officer that my case is approvable but will have to wait for Visa #.
This is actually a good step for your case processing. After this usually they just wait for visa# to approve the case and feel free to ask question to USCIS officer at the end of interview, they are nice.
I have a post somewhere on IV where you can find the list of the questions asked.......hope this helps....!!!

I recd supplementary forms to I-693 for my wife and I from the Civil Surgeon earlier this week. Along with the supplementary forms I recd two envelopes (one addressed to me, and the other one to my wife) that had DO NOT OPEN written on them. I sent these to my lawyer's office.
I called the doctor�s office and this is what I found out. Apparently, when the doctor had first given us the sealed envelopes (in June 2007) she didn�t know that the Supplementary form needs to go with the certification she provided us in the sealed envelopes. We sent the sealed envelopes with our Concurrent I-140 = 485 application recd at NSC on 7/2/07 (as per UPS). Now, some of her clients have recd letters from USCIS asking for the Supplementary form, so she has sent the same out to all of her clients regardless of them getting a letter from USCIS. I hope our application doesn�t get rejected due to this; no checks cashed as of today.
My lawyer's response: No the application should not get rejected because of this...however we will submit the supp doc's report to the USCIS when we get the receipt notices.
Anyone else in the same boat? Is this something to worry about? See signature for more info...

We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-
-Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
-How does one activate his/her EAD?
-Have any other late june filers already got their EAD?

A 700billion$ bailout is not helping much. You think we can help the economy? We are at the mercy of the employers whose earning results are going down because of recession. :( It is hard for me to believe that we can help the economy by buying houses and how are the law makers going to get convinced? Show me the proof.
I am not sure it is simply US$700 billions. Europe is also coming out with bailout package of US$2000-3000 billions.
Let me take example of India: I heard someone talking India coming with Rs. 100,000 Crore (US$250 billion) bailout, some other said no it is Rs 60,000 crore. Between these talks, one airline asked for Rs 5,000 crore bailout. So follows other industry.
So now this is economy of bailouts. I am sure several other countries also must be planning bailout. US has $10.2 trillion US national debt (FED loan), but current external debts are too much (US$16.2 trillion in 2006 ) and govt liabllities US$59 trillion. Refer to http://en.wikipedia.org/wiki/Economy_of_the_United_States
US economy desipte problems is so strong that all the bailouts directly or indirectly supporting business in US. So the US$700 billion is just a symbolic figure. Actual support to US economy could reach US$ 4-5 trillion through worldwide bailouts.

I am in 9th year extension with priority date 09/2002.
My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:
I have Visa vailid till Jan09.
1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.
2.Is the Priority date transferrable if I change the employer?

meridiani.planum, thanks for giving me red. I dont think EB2- India will go back to 2002/2003 for the October 2008 visa bulletin. Even if it goes back to that old dates it comes back to 2006/2007 very quickly.
