    Friends,

    my company's lawyer will be swamped with new I-485 applications, since everyone eligible is already sending applications.

    I am in the process of preparing 2 packets so that if he delays I can file by myself before retrogression hits again.

    Now, my question is: Can I attach a courtesy copy of already approved I-140 when filing I-485? Also I do not have A#!!! I guess that is not all that important, since when my I-140 was processed there was retrogression.

    Word of caution for everyone: On June 16th USCIS published new memo overriding Yates memo, basically saying that they will have a descretionally right to either issue RFE with less than 120 days for response and/ or deny and reject cases where initial evidence is missing. So, carefully prepare all your applications...check all docs and files, money orders, filing fees, etc etc...

    I filed my AOS at the beginning of May and included a copy of the I140 approval notice. My A# was on my approval notice fortunately. I carefully put my packet of application together according to my employers instructions so this memo is not much use to me right now. However, am hopeful it all works out since we have already had fingerprints done within a month of application. I believe that if they simply deny all applications if initial evidence is missing, however, that chaos would ensue and they would be bombarded with appeals. Not good for anyone involved.

    I was under the impression that this organization and its resources are to be used for a 'rational' purpose of finding out ways to stay in this country and not the other way around...

    One can go back to his country even after becoming an immigrant i.e. getting a Green Card/US citizenship so I dont see how the objective of IV and this thread are mutually exclusive.

    We have all applied for our GCs, and are stuck in retrogression. We could choose to stay here forever after getting our GCs, or go back to our countries in the long (or short) term.

    IV will repel genuine people ....

    I am not interested to be a donor and will contribute based on action plan as I did before and did contribute a good amount of money to IV - but what I hate to see is people like you - being a donor you think you got the right to insult non-donors ....

    the way IV forums are being used, very soon I may run out of option but to disassociate myself with it... Its sad but that is the fact ...
    I don't know why people get offended so easily in an open forum like this. Why cant we take it in a good spirit and move on. If people cant even take it as a joke how are we supposed to work together for a common cause. IV gave us a platform and if people who started IV were demanding action plans from everybody else, then we would have reached nowhere.

The negative energy, stupidity, arrogance and the ignorance of the members fighting is sheer pleasure that you cannot live without.

    The classic age old laziness. What joy is there in getting you GC sooner? You may live a free life without any worries. The sheer ecstasy of being being worried about your future, that your laziness ensures you get, cannot be compared with anything else you experience.

    The joy of inaction that ensures getting your GC a few years or possibly decades later or not all is in no way comparable to the pain of getting your GC soon by working on advocacy to fix your issues.

    1. You love the limbo.

    Who doesn't? The ultimate joy in the world. The state of uncertainty. You just cannot compare anything else you would want in this world than for the joy of being in this limbo.

    The excitement that envelopes you when you think:
    a. of whether you will get your GC ever or
    b. of your uncertain future for you and your family or
    c. that you will get your GC in a decade or not at all due to anti-immigrant measures that may pop up soon

    is nothing to sneeze at.

    You just love the limbo you and your family are in. Who would want to let go of this wonderful state and have a certain future. come on.....

    Often times, thinks are better explained with numbers and examples.
    The way the bills are laid out
    EB1/2 - 4350
    EB3 - 10100

    Now, there are 270,000 pending 485 applications and about 350,000 BEC labors pending. Reduce this number by about 100000 for visa recapture from 01-05. So, left is 520,000

    Approx. 33% should be applications from India - ~170,000 Indian families waiting. I am not counting dependents as that should go away with this bill.

    Now, assuming 20:20:60 EB1/2/3 distribution, we have
    Eb1 - 34,000
    Eb2 - 34,000
    Eb3 - ~100,00
    1. I am guessing a sizeable percentage of Eb1 from India will be PhD holders, so I am making a random guess of 80%. So, 8400 EB1 Indian applications will require visa numbers. So, ~8000/4350 = ~2 years to resolve retrogression.

    2. I am guessing 50% of Eb2 applications are people with MS+3, leaves 17,000 Eb2 requiring Visa. So, 17,000/4350 = ~4 yrs to resolve retrogression.

    3. I am guessing 25% of Eb3 have MS + 3, leaves, ~75000 applicants. So, 75000/10000 = 7.5 yrs to resolve retrogression.

    Based on current system, I had done some previous calculations which had Eb1 wait times as similar (2 yrs), Eb2 (6-7 yrs), and Eb3 (10-12 yrs). So, the way the bill stands, we will have a couple of years of improvement of wait times.

    Another thing I have missed is that I know a lot of people who are currently enrolled in part time Masters programs in US. They will benefit and will get out of the queue bringing wait times down significantly. Overall, this is better than what we have today.

    In the same vein, Indians and Chinese folks will again get screwed. In the worst case, if we have to live with the removal of the clause, we should get the filing 485 with out dates current provision in or at least something like 3 yrs of waiting leads to EAD etc.

    Immigration Voice core group, can you guys work with QG&A to better understand the impact and the solution.

    Just in case there are more delays, does anyone here know what is the procedure to get Interim EAD ?

    Is Interim EAD given only if card is not approved or is it also given if there are production delays..

    Has anyone tried Interim EAD approach?
    funny but this is what i heard... the whole problem is with delay with printing cards since local facilities no longer issue cards it has to again go to central facility but they wont issue once card is approved...

    I hope folks here know that the tax rebate check is an advance on your 2008 tax return. It really doesnt matter if we get 600/900/1200 because when we file return in 2008, IRS will deduct the money from your refund. No free lunch!

    As far as I understand it, it is a credit for your 2008 tax which is already paid in 2008
    and not in 2009. But different from exemptions on a W-4, you don't have to return
    this credit if you don't qualify next year. It is a real tax credit. In 2001 there
    was not a credit but a change in the tax system and you could get an advance
    rebate.

    It's a free lunch if you measure it in Dollars you receive. In reality it is just
    newly "printed" money. So the dollar will have less value (inflation) and a person
    who doesn't get the "rebate" is cheated. The economy will collapse anyhow.

    We know how fluid the whole process of lawmaking is. First we have Senate bill, it goes various modifications in the Senate itself, then same thing in house.

    Then president signs it.

    Then there maybe a gap period in the bill itself before the laws can become effective.

    Then USCIS interprets it and implements it. In all this various effective dates are liable to be changed. I do not think any US election results are going to be effected if cut off date for merit based system is May 21, 2007 or Oct 1, 2009. There does not seem to be a need to legislate cut off dates concretely. USCIS should be able to change them to whatever they deem fit.

    Only then things start effecting people.

    I have a strong feeling that people who have filed I140 or are about to and are close to current PD or are current PD will be fine and do not need to be scared.

    No doubt the industry lobby is verrrrrrrrry strong. But the AC21 measure also allowed employees to change jobs; not sure if that was entirely in their interests.

    In any case, tying our fate to H1B is not a wise thing to do. The house will reject it one more time. They simply don't want the H1B increase. What we saw last year is an increase of only 20K for folks with advanced degrees in spite of the industry lobby working so hard. The industry lobby would have liked many more H1Bs. They don't care for the green cards or the plight of those trapped in the process. I have heard a top exec from a top tech firm say that after they finish their 6 years on H1B, they are welcome to go back! Actually, many prefer it that way. Alterego, you've pointed out correctly that the industry cares for NEW workers.

    If anyone is seriously thinking that the industry lobby will (in the lame duck session maybe) sneak in an increase in visa numbers in a bill that asks for more H1B, he/she is in a state of delusion. Had they been that concerned about the issue of retaining employees, they would have asked for higher visa numbes when they lobbied succesfully for an increase in H1B itself during the Clinton years.

    IV's is on the right track. It may take time to get them to understand the difference, but it is achievable in a year or two. What is also likely is a temporary increase in visa numbers; this was done some time back, and we should have no problems with that.

    My friend, you can't have it both ways. Either you believe that most of industry wants to retain their best overseas employees like you said earlier or you think they want you to leave after 6 yrs like in this post here.

    Likewise you cannot refute that every single time this issue was addressed it has been both H1b and visa numbers together. So why do you naively believe it will happen this time? Have you even looked into AC21 ? There were almost 250K visa numbers recaptured in that law, that was the whole reason PDs were current until last year. So in fact, both H1b quotas and visa number quotas were upped for a couple of years. In addition, when the budget bill was passed last year before IV was formed, who do you think tried to add in all those provisions for recapturing visa numbers, excluding spouses from the count and so on? Try to get your facts in order before just posting.

    I believe most of american industry wants to see a way to retain the ones they choose as the best, and hence they are not for reductions in visa numbers. They are simply not as agressively pushing it as it does not address their immediate needs the way H1b quota expansion does. In addition they have come up against a group of people/companies who have learnt how to utilise this whole H1b process in a way perhaps that it was not intended ie body shoppers. However that is for industry to figure out and lobby against if they do not like it............... and dare I say if congress stands firm on the H1b numbers that is precisely what the tech. titans will eventually do to protect their access to foreign talent.

This discussion was not a general EB2 VS EB3 discussion and I wish Moderators kept this thread as is for easy identification. I had to spend about a week on all forums to get the info about the 3 year engg degree cases and it is very difficult to get info on this specific group.

    Thanks invincibleasian and macaca. I am working as a contractor. So I cannot stick to one place as I need to move to places where ever I get the project. I see the only option for me is to do the online MS.
    1) Does any one knows the list of universities which allows to do online MS?
    2) I am B.com graduate (Bachelor of Commerce, whis is 3 years degree) and done LLb (Bachelor of Law which is 3 years degree). Will it fulfill the eligibility requirments of 16 years education in order to do MS?

    I don't understand why people are waiting for approval from IV? We are doing nothing illegal if that is what you are afraid of! Or are you afraid that the USCIS will come after you because you sent them Flowers???

    If you think sending flowers are a good idea then send them PLEASE! Currently people have ordered flowers with a delivery date of July 10th. It will be great if USCIS gets them all on the same day!

    Don't wait for approval from IV! You are all individuals you can make the decision for yourselves!

    I saw it too. He was trying to reach out to Sensenbrenner. However, I am not sure Sensenbrenner is ready to accept reality yet. He might feel if it needs to get done he does not want his name attached to that legislation. He has stated that in the past. Interesting to see whether he will listen to the people, and atleast shape policy while he has a say or simply and stubbornly stick to his guns and let the 110th congress do the work.
    This has been the problem with the 109th congress across the board. They did not negotiate, they simple followed the majority of the majority rule and to hell with everyone else, this is why they got so little accomplished. That is not the right approach in a democracy and the american people told them that this week.
