Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..
``(I) the employer with whom the H-1B nonimmigrant would be placed has not displaced, and does not intend to displace, a United States worker employed by the employer within the period beginning 180 days before and ending 180 days after the date of the placement of the nonimmigrant with the employer;
``(II) the H-1B nonimmigrant will not be controlled and supervised principally by the employer with whom the H-1B nonimmigrant would be placed; and
``(III) the placement of the H-1B nonimmigrant is not essentially an arrangement to provide labor for hire for the employer with whom the H-1B nonimmigrant will be placed.
the big consulting companies (IBM/Deloitte/Accenture et al) will try to get a waiver by showing the 3 conditions above - however, they need to do so every time a current assignment for their H1B employer ends and they need to place them on a new assignment / client. At that time they need to go through the waiver again, to determine whether the end client has had any layoffs in the last 180 days.
In short this bill is a disaster for ALL CONSULTING companies that have a large H1B population.

Organizations who have Millions of dollar In budget for pushing and lobbying their Issues failed also for whatever reason ( He did not mention reasons ).
Does that mean that having a fat budget does not Impact the outcome ?
What It proves Is Its really the Politics, election, People's focus on the Issue which matters and NOT the lobbying with big fat budget.
And If its the case then our issue will be taken care of on its own merit when all above factors are in our favour, regardless of lobbying.

I support this idea to have a funding drive to help Aman recover his financial losses. We can never thank enough for the time and effort that was put in. Its a pain we need to share. Celebrating and saying thanks to IV is nice. But contribution is only way to say thanks. Think about it if we had to file with new filing fee, we would have paid 3 times what we paid now. Its amazing and we are fortunate to have people like Aman, logiclife and other IV core have such selfless and sacrificing nature.

One has to remember that the famous "AC21" is also a memo! My only concern is that we need to have a really good reason why we think AC21 is legal, and should be abided by, by USCIS, but the latest "E-E Relationship" memo is not legal, or is unjust...
AILA wants to fight this on the grounds that such directives cannot be mandated in the form of a memo, but laws have to be passed. What if USCIS retracts the AC21 memo on the same grounds?

I think canadian IT jobs will accept US IT experience. However, getting a job there is harder because the industry is small but then again you don't have to be in IT. You are free to start a business there. I know ppl who have come from India to canada and have started insurance business etc. Like moving to any other place, its going to be a fresh-start if you choose to go to canada/Aus/India/etc.
One of my friends who is in Canada for a few years now tells me that the Canadian companies do recognize US experience. Another friend recently finished his MBA from the US ( after he went through the whole MS, job at a top company, GC process where labor got rejected after 4 years nonsense). He moved to Canada with a job offer, so it is much easier for him. Just don't go there and think you will find something. Make sure you have a job offer and only then go there.

I have posted the exact same question on Rajiv Khanna's website.
He did answered this question. According to him this is possible and also asked
him if i need to go out of US to get the H1B stamping, he replied this is NOT requried and
the new H1B Transfer will be approved with I-94 attached to it.

If it is India EB2, then yes, but I guess once ROW eb3 becomes current, we can see unused visas flowing in from all directions (Just a speculation) and PDss may move afster. But forr now, God knows when the PD will move.

As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.

Yes, that is right, I said �plight of EB2-India�.
I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

This is completly wrong statement. Actually, it is otherway. The EB3-ROW is currently enjoying at the expense of EB2-India and China. It is enjoying not only in this year. It is happening since 2005. If you have doubt, please visit DOS website and anayze the statistics right from 1999 to 2005. Furthermore, all the AC21 numbers (about 150,000 unused visas) that was captured in previous years (1999-2001) that came from unused EB2 and EB1 numbers. Theoritcally, these numbers should have been used to reduce backlog in EB2 first, then it should go to EB3. Since no one cared about this, EB3-ROW was free riding in EB2 numbers despite heavy demand in EB2.
Everyone knows that EB3 is heavily retrogressed compare to EB2. No doubt about that. The only solution for this is to increse the numbers. Everyone is working hard. However, it does not mean that one should ignore how DOS/USCIS mis-interpertinng the law and doing harm to EB2 Indians and Chinese. No one here is to sacrifice for EB3-ROW. Fighting to eliminate retrogression and understaing the correct interpretation of law and rule is totally two different issues. Please do not confuse between those.

2005 : 1350 (EB2-I : 675
2006 : 22298 (EB2-I : 11149)
2007 : 24573 (EB2-I : 12286)
2007 before July 2007 (approximately 65%)
July 2007 : 15972 (EB2-I : 7986)
2007 labor approval is for FY (up to Sept 07). If person have approved labor before July 2007, 99% he/she might have filed I 485.
Consider derivative (Dependent) factor : 2.5
Following numbers of I 485 pending applications for EB2-I:
2006 : 27872
2007 : 19965
Total : 47837
As per Sen Kyl's information pending I 485 for EB2 India : 51717

how can i talk to those knowledgeble service reps from the service center. can you please suggest me how i can get to them, i have been trying to talk to them since morning and i could not get beyond the first service rep. any tips on how to get to them
