My H1B going to expire Jan 2008. I am not planning to renew it. My PD is current (india-eb2 2004 jan). I am planning to travel in March 2008. Do I can travel with AP, without valid H1B papers. ? Do I need to renew my H1B ?

Maybe I am being naive. But we are not a political organization. I sure do hope we are not. We should be open, clear and precise about our goals and our funding sources/drives. Frankly our opponents pump in millions of dollars into their effort. Maybe one of these days we can compete with them monetarily. But all I know is they can get millions of dollars but not 25000 committed members.
Also please consider that charging people for reading posts et al or instituting monthly payments will drive people away. People who cannot pay will not pay. All we lose is participation which is more important. You will agree that we want more participation not less.
Hence IMHO we disclose our goals. We disclose our costs up front. We have nothing to hide.

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.
and also we can transfer our H1 to new company also. thats what i am doing now.

If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. often i'm amazed by the knowledge of some of the posters here...... but more often i get a laugh out of stupid ideas that r thrown around...... for example u want something big.... want to send transcript..... blacking out the name...... if there is no name on the transcript..... how will anyone know if its genuine...... so u r still afraid of someone knowing u'r name... but u want to do something big....... that makes real sense...... if u know what i mean..... then u want someone else to do a rally....... r u going to come to the rally?..... how will u hide u'r personal information when u come for the rally....... maybe time to take out the Halloween nixon mask.... to protect the personal information/identity..... and for the hunger strike.... lets have someone with a nixon mask do hunger strike...... we could just say that its not me who is doing the hunger strike.... its president nixon doing hunger strike on my behalf....... great idea...... by far the best one ;)

Got a RFE for my spouse's TB test as it was not submitted at that time...
gcisadawg, remember, you can get from a pediatrician or whoever BUT as you know they should be "Certified" by USCIS for you to go get from them...dont forget that..and based on the links I referred to you earlier you dont have too many options abroad...basically a center where you may have to go and get there..
To avoid all these headaches I would go try to get more time by asking USCIS..

This is completly wrong statement. Actually, it is otherway. The EB3-ROW is currently enjoying at the expense of EB2-India and China. It is enjoying not only in this year. It is happening since 2005. If you have doubt, please visit DOS website and anayze the statistics right from 1999 to 2005. Furthermore, all the AC21 numbers (about 150,000 unused visas) that was captured in previous years (1999-2001) that came from unused EB2 and EB1 numbers. Theoritcally, these numbers should have been used to reduce backlog in EB2 first, then it should go to EB3. Since no one cared about this, EB3-ROW was free riding in EB2 numbers despite heavy demand in EB2.
Everyone knows that EB3 is heavily retrogressed compare to EB2. No doubt about that. The only solution for this is to increse the numbers. Everyone is working hard. However, it does not mean that one should ignore how DOS/USCIS mis-interpertinng the law and doing harm to EB2 Indians and Chinese. No one here is to sacrifice for EB3-ROW. Fighting to eliminate retrogression and understaing the correct interpretation of law and rule is totally two different issues. Please do not confuse between those.

-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?

I am tired but I would like to do something while I am waiting... that's why I am thinking of starting PMP. That way, if I eventually get GC or end up moving to some other country I will have some value addition.

Stucked with current company...being under appreciated and under utilized by the current employer...not a place for me to build my CAREER!!!
Have potential contract jobs/independent consultant positions available (recruiters contacted me) which pay 50% than what i am making now...but can't accept those offers bcos of GC!!!!
So so tempted to return home for good (sick and tired of the WAIT), but Everyone was saying "u had waited for years now, so why not wait for another year or so to get it..don't waste the golden opportunity" But...but...is it really going to be just another YEAR? :rolleyes:
Sigh...sorry for venting...but i am really upset!

Yes you called sleazy consultants..check your stmnt.
Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.
A fictional scenario to check whether you are ready to take advantage of a loop hole if its in your favour.( A nice quote on this -Everybody likes discrimination when its in their favour and they dont raise their voice then)
My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.
Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast.
