    Think before you type. The core team mentions $$ and ground work. Most are not interested in doing anything besides reading these forums. Realize the enormity of the task, the efforts required, then look in the mirror and ask yourself what you did besides BS'ing


    As mentioned In Logiclifes first post in this forum,
    Organizations who have Millions of dollar In budget for pushing and lobbying their Issues failed also for whatever reason ( He did not mention reasons ).
    Does that mean that having a fat budget does not Impact the outcome ?
    What It proves Is Its really the Politics, election, People's focus on the Issue which matters and NOT the lobbying with big fat budget.
    And If its the case then our issue will be taken care of on its own merit when all above factors are in our favour, regardless of lobbying.

    Just a thought, I hope I am not upsetting the general trend of praising efforts.

    I suggest that you remove the glass house proverb. It makes the letter look a little unprofessional. Your letter without it is already very effective. Also put the "H1-B workers are illegal" quote (if there was such statement made on his show) at the top while you put across your objection. If such statement wasn't made but implied by the guest on CNN, don't put that in quotes.

    Abhijit, Thank you for your suggestions. If you watch the Utube video, Rep Tancredo clearly said that H1-B visa holders overstay their visas. As far as the "glass house" goes I can't change the petition even if it has one signature. I wrote this to create maximum impact and we can only hope that it does.

    If you have high ethical standards then you will call your company and tell them it is wrong.That what you do, instead of painting everybody (indians) as bad. I came here on F1 studied here got a job in campus interview. I could have gone to a desi company and earned about 20 % more than what I did, but I did not. its left upto each individual to take his own decision.

    I resent this thread which asks, are we responsible for this. Who is "we", certainly not me and certainly not a lot of hardworking and honest people.

    Thats what I meant when I said stop responding to this nonsense. Are we going to have a discussion on every negative thing the anti - immigrants say.

    My company posted on Dice&Monstor, 10-15 versions of my resume with diffrent combinations of my first name/fathers name and Last name.....

    They call it..."Marketing" your profile!!! The American recruiters who knows me, use to call me & tell me that they have "hit" of my resume with names like...A.ASH or S.ASH or H.ASH...and so on..while the content of my Resume remains same!!!

    I mostly get reds for being honest and stating the facts but that doesnt matter. I have to agree with Nathan, dont get emotional, lets see how to get out of this mess. As you stated, your employer didnt invite you, the only thing he should have done that he didnt do was recalled your petition when it became effective. He will get away with a warning and a small fine unless he has done the same as a pattern.

    You can get him in real trouble, (of course but only by doing damage to yourself) by proving you paid the money for the H-1 and I sure here too, you would have given him a check and he would have given a company check to USCIS and you are going to make life more difficult for you than for him as proving you paid the money for the petitionis going to be very difficult.

    This is the time to sit back and think what is your real goal. I guess, it was to come here and work hard and succeed not make life miserable for everyone involved. Trust me Honey attracts more flies than vinegar. Speak to your employers softly and try to find a solution. If you need help finding a job, I am sure there are plenty of avenues, especially with the market improving.

    Now dont jump into conclusions, that I am another consultant or work for a consultant. I am neither.

    Yes I agree with you legal immigration is not only EB category, but EB+spouse+child category is the largest when we say Legal Immigration, plus questions are posed by Engineers & Doctors and that automatically tells the person who is reading that it is about EB category.     Employment based immigration is a very small part of legal immigration.

    1,266,264 immigrants were granted legal residence in 2006.

    159,081 immigrants who received green cards through sponsorship from their US employers accounted for 12.6% of all legal permanent residents.

    However, 87,702 (or 55.1%) of the employment-sponsored immigrants were spouses and children of principal applicants.

    The share of employment-preference immigrants has varied between 3.3 percent (59,525) in 1991 and 22 percent (246,878) in 2005.

    The other categories are family preference (802,712), refugee + asylee (216,454), Immigration Reform and Control Act (IRCA) of 1986 + parolees (43,546) and Diversity Lottery (44,471).

    Employment based immigration is legal. However, it may help to add legal to the title.

    Employment based immigration is skilled. I think employment based immigration includes cooks, priests, .... They consider themselves to be skilled just like everyone else!

    If you just ask for improving legal immigration, they will improve family based or asylum.

    As some persons learnt yesterday, legal immigration has very low priority as compared to undocumented. Similarly, employment based immigration has no priority in legal immigration!

    if the transfer/extension of H1B gets rejected after travelled on AP, is it possible to move on EAD and continue working legally? I am talking worst case scenario here.

    Although my lawyer confirmed that one can still have a valid H1B status after travelling using AP. My co-worder is still in doubt. Our corporate attorney seems to be clueless for this tricky situation.

    Even USCIS is clueless. My feeling is that generally (about 70-90% time) they will grant the extension/transfer as it brings lot of revenue (fee) for them. But, if some officer may feels that, to seek the transfer cum extension one should be in same status. It is hard to convince them in case of RFE, as there is no specific memo/policy/regulation for this situation. It also fuels the natural doubt of the officer?. Why the AOS applicant entered on AP seek non-employment chage of status (instead of using EAD)? Using EAD and AP is simple and avoids complications in employment transfer. This is my view.

    To answer your question, you can use EAD in case, if your H1B transfer fails.

    We already have chapters as the first and foremost source of valuable information. Once someone becomes involved and committed, they will signup for monthly contributions themselves. If we have enough of that to guarantee a decent source of recurring income like 20 40 k or whatevr, I dont see the need to deprive some depressed soul surfing the net looking for some reassuring information from having to goto bed in peace.

    [Mr. Brown] True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.


    [harikris] Plan B/C comes into play when plan A is logically terminated. That is not the case here Mr. Brown. The process should be fast enough not to allow a life changing event to weigh in on any individual to continue with an initially chosen plan or to abandon it.

    [Mr. Brown] Given the passage of time priorities/drive should be geared more towards securing and making the best of what you have (home country's citizenship) rather than what you don't have (GC). Heck, even retirement based mutual funds work in that fashion (aggressive at first, conservative as time passes).


    [harikris] Going by your analogy, most "young" folks do play it aggressive(risky) by following up on their dreams and when it is time to consolidate/secure, they are facing uncertainties that are not quite under their control. We have to take their word for it, if we are to have any solid grounds for making a case against backlogs. We got to STOP taking their statements with a "pinch of salt" and "wink-wink" fashion because that would mean we have lost the fight even before we enter the field. We got to "help" USCIS and work with them so that they can help us.


    [Mr. Brown] You nailed it. I completely agree with you and guess what this arrogance from USCIS will come back to bite them but it will be too late. How do you think empires that rule for centuries crumble in a few years? Empathy (or lack-thereof) can bring one down to their knees.



    [harikris] Thanks. We surely don't want to wish the vehicle [USCIS] that is supposed to take us to our "destination" to crash fatally. Let's strive to put USCIS back on track.

    [Mr. Brown] Nothing. As second class citizens (GC/USC or not) we don't have a say in this society. We give some to get some.

    investing on IT?

    are they just adding equipments or are they migrating to a new system? i hope they are not migrating so that they don't have to deal with the learning curve.
    one of the Justification for Fee increase given by USCIS Director was for investing in hiring new personel and e-processing. I guess they will try to convert some of the applications to filed electronically , which would free up their resources , who will probably focus on backloggs

    I like majority of others who came here on H1 with genunine intent of settling down should work toward common goal of easier GC processing and not support outsourcing idiots esp L1s who is nothing but shipping jobs overseas and making a field (eg IT) minimum wage pay. Just look around how much TCS pay .

    COmmon goal of us is easier and humane green card processing and to work towards the goal to stop blatant abuses in the form of L1 (and some H1 )

    Watch your language.. My friend.. don't throw your rotten ideas as facts

    TCS for deputed employees
    1. 60.5 K -70 K
    2. Full medical insurance (whole family) from Cigna...
    3. 401K 4%
    4. All travel and relation expenses
    5. So many...
    --> better than most desi employers

    If you think that there is abuse in L1 so in H1

    Becasue of so people like you anti-I could able to successfully devide us.

    If you think that out sourcing and sending jobs to India is utterly wrong.. so giving jobs to foreigners in US.
    You and me are here because of globalization, if we want to get PROTECTed from MORE globalization.. for sure every body will suffer, Indians (in India),L1,H1, You, me, Even Citizens.

    And if you are an Indian and going to loose job in USA because of the ptotectionizam you will end begging a job from the same Indian outsourcing companies. Watch out..

    Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.

    In my view your words "Get a life" certainly applies to the following set of people (in that particular order):


    Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.

    Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.

    Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.

    Those who build up their hopes with predictions on the next visa bulletin and go emotionally crazy when the hopes crash with the release of that bulletin. I mean c'mon ... flower campaigns? hunger strikes? Are you that naive to think it worked the first time? This ain't a factory in India and we aren't a group of union workers.


    The above form a very small group of people on this website and that is where the problem lies with your post. You are basically stereotyping all of us into a category formed by a small group of people.

    Anyway, good to know of your Canadian PR success ... good luck!

    To those who fall in the above 4 categories take the time to realize that its all in your head. Be strong and prepared mentally. You've done all you can in an honest way. If things don't work out then so be it. Sometime in the future you will realize that it was all for your own good. Move on in style to your next adventure ... it's waiting for you.




    This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.

    Few points:

    1) having gc is a privilege not a right.

    2) US has every right to choose whom they want to have in their country.

    3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.

    4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)

    5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.

    Wake up friends, you have options. Don't let your life depend on you application status.

    I was thinking about this today.

    All great Ideas and we are never short of Ideas on this website. However, we are always short of commited people who are willing to put in time and make their Ideas become a reality. We sure are 25,000 real members and If each of us commit 10$ every month diligently we have a consistent cash flow of $250,000 every month and committing 10$ every month is not hard at all. All of us in here are highly skilled, we all have decent paying jobs and we are definately not cheap labor because we have US Department of Labor (DOL) certifying our salary before we take up any Job in this great land.


    Would you be willing to the lead on making your Ideas become a reality. We have very few highly committed members in here who can provide support and guidance.

    We have already guided a few people on how to donate amounts less than the ones that are posted on this website and it is really simple. Any amount can be sent in as a donation through paypal to donations@immigrationvoice.org

    I know many of you may have already thought about this at some point. I'll lay out my views on the donations...IV can object/correct.

    I'm following the donations thread along with many of you and there is not much to be excited there.2000$ in 2 weeks....for all the Agenda that pappu has posted. I understand that everyone(including me)...will have limited resources at our disposal every month...may it be mortgage/daycare/medical/school or those unexpected repairs...so the bottom line is there is not much room to increase our monthly contributions or...holiday contributions.

    I was thinking...we are 25000 'real' people...and there are more than one visit by each person to this site.

    1. Can IV use any space to advertise...so that IV can get some AD Money?

    2. Is it possible to get some space on popular pro-immigrant or immigrant driven websites...to donate to our cause?

    3. Would it be possible to split the donation denominations further down...like 5 dollars..or even low..so that all immigrants...including people who got the GC's/Citizenship can contribute with out looking deeper into their pockets.

    4. Optional....ebay/paypal donation to the peoples questions/answers...Mind you it is totally optional...if you want to donate 5/10/20/100...or how important the question is and hw satisfied the person is with the information...etc

    5. DOnation boxes at Immigrant owned grocery stores...with out compromising their principles

    Folks, I have layed them out with good intentions...and have also given a thought of what I personally can do for each point above...I'm not expecting the vultures to prey...on the post with mundane comments.
