EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.
Out of 140K Visas 7%= 9800 is assigned to India (All Categories)
Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(
From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(
EB3 India is lowest on the FOOD Chain!!!
EB3 India is not unlucky but thats the default category for any one to apply when they or job doesn't let them go for Eb1/2.
So the obvious reason is:
when we have brand new lot of 85K H1s most of them apply for Eb3, and big chuck is Indian (no 7% cap here), but regardless of category, if 85k applies for GC, with one dependent it counts 130k.
And for GC allocation we have country cap which is ONLY 7% when we have 70% applicants. Do the math, 85000*.7*2= 119000 applicants for GC from India each year and they are entitled for 140000*.07=9800 and now lets say with all favors from ROW and EB1 we got double say about 20,000 still there is a back log of about 100K each year.
Thats assuming everybody applies for GC out of 85K H1 stock.
Based on this I don't see EB3 to become FIFO or backlogless because the system is not balanced,

Friends, I understand the concept of marrying before and after 485.
My question: Lets say I go ahead and apply for 485. However, my H1 has expired, so I will be traveling on AP. So when I travel outside the US, I am technically not on H1, when I come back...am I right? So, if my spouse wants to apply for H4 visa will she be granted one? Since I had traveled on AP? I am sorry if I confused this with EAD. Bottom line, my H1 stamp has expired and I do not intend to go for another stamping while outside.

Can you please provide more details on starting a part-time position and what are some of the complexities associated with it?
While I was waiting for GC, I finished MBA last year. I have a Masters degree in Comp. Sc. also. It has been 4 1/2 years with no clear indication regarding the LC alone. Hats off to the screwed up concept of BEC. If my LC is not processed in time, I might leave next year.
I am thinking of doing a part time job on H-1B also. If that pans out well, atleast I will forget the pain of GC for a while.

Well if we were to carry your reasoning a little bit further ...being a citizen of a country, any country, is only a privilege and not a right as you have to follow the rules and laws of the country.
The actual difference is in the definition as has been pointed out earlier.....
"right" - is something you can ask for because you think it is reasonably fair
"privilege" - is something you are not entitled to or deserve but nevertheless get because someone condescended to give it to you.
By the above definitions what would would classify getting permanent residence as.... the answer lies in the broader way of how we look at life and live it.
Do we always live in fear and cower in front of real and imagined threats - the GC is then a privilege.
Or do we live an honest life - do the best we can - and stand up for what we think is right or wrong irrespective of whether our lives are directly affected or not. The GC then is a right.
Getting a GC in United States is our dream. Following rules and following laws of the system is all what we can do. We can only highlight the defects in the system and ask for a change.
We live a honest life not out of fear of getting caught, but because we believe that that is the right thing to do.
If you are a citizen and stand up for what is right or wrong, then the concerned authorities should seriously look into it.
But if you are not a citizen and stand up for what is right or wrong, then you may be appreciated for that and receive a thank you note. The concerned authorities may or may not pay attention to your concerns. I may be wrong but this is what i feel about it at this time.
Convince me otherwise and i will change my thinking.

If you can porting to EB2 is always a better choice.
For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.
HR 5882 is the only solution for all atleast for this year.

Completely understand. No problem. Being in the hellhole of backlogs and the gaps between jobs, benches(not a pleasant time period in consulting) etc is the worst kind of hell and under those circumstances even $10 is worth much much more than $10. Your belief in this mission is invaluable.

There is not much we can do. From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

If you look at the PD progress for EB3 I, the only movement was during March and April 07.

if the recapture bill doesnt pass, we are looking at something similar this year too, very little movement. My guess is that EB 2 I is also going to retrogress a bit, simply because of the number of applicants in that category. EB 3 ROW will also see slow movement because of the distribution pattern.
My guess is that it will move a bit more faster than last year. Note that Apr 22 was the hump day (been dealing that that day right through labor certification phase), after that, the movement was steady. The Nov1 showing up twice is due to exhaustion of the numbers. I am expecting a steady march going forward.

Yes, our success has created these issues for us. We are sincere, talented, educated, skilled and experienced. In my view, three things perpetuate this:
- this republican regime, the way its runs government (hence throw the bums out)
- lack of interest in our issues by our predecessors who have GC in their hand, our community leaders
- general introvert nature of Asians(aloof, not interested, not outgoing, not mixing, not greeting etc)
There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?

It reminds me this story every time I visit IV.
Workers working with an export company which use to ship chickens from all over the world to US/Europe, were packing chickens from some Indian port. Each box was having some 50-70 chickens in it .
After loading them in, they were about to cover these boxes with the tops. The leader shouts to workers: " No need to put the tops. They wouldn't go any where "
Surprised with this order, one worker asks the leader 'Why'. The leader says : " These are Indian chickens. IF one tries to escape, other will pull its leg."
