Hi All,
All this memo states is that USCIS will not automatically expedite the FBI name check simply because a writ of mandamus is filed. This memo signaled a national shift in the way USCIS responds to these types of lawsuits.
The U.S. Attorney's Office will now fight the writ of mandamus lawsuit by filing Motions to Dismiss and Motions for Summary Judgment. While this obviously lengthens the time it takes for a case to proceed, it is still very possible to win and force the government to adjudicate the application.

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. It has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..
Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..

Good Questions. Would you be willing to jump into the field and start motivating people to be part of IV and be actively involved in IV Action Items?. Would you be willing to find out what is stopping people from getting involved with IV?. We are always short on Volunteers to work on IV Activities and we definately welcome newbies willing to work for this cause. We have a few highly dedicated volunteers who spend time educating other people about IV, forming state chapters, recruiting members into state chapters, organizing chapter events, raising funds and the list can go on. These volunteers have 24 hours in a day just like everyone else and they have full time jobs, families, careers, schools to attend etc. Would you be willing to go out and recruit volunteers for us?

Just so, everyone understand, I am not trying to find fault with IV or its members. I am trying to do, what you can call, soul searching.
We have around 25000 members. Why only 25000, when we know there are millions out there in the same boat. What is stopping them from joining IV and contributing? Of all these 25000 or so members, we only have around 4000 letters sent for Admin fixes.(May be I am wrong about this number, but I believe it is around that range.) What is preventing the others from doing so?
I strongly believe, that the answers to these questions might help IV in the long run, with more members and possibly more active members. Once we get to that point, IV will no longer be an organization, but it will be a MOVEMENT. Chances of success for a movement is always better than that of an organization. That is what I believe we should try to achieve. I hope everyone agress with that.

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

You mean EAD, not AP, right? AP can be used in conjunction with EAD.
Also, you can file for both EAD and AP and not use it. Just having the two will not force you to have 1 year extenstions. You can still get 3 year extensions if you don't use EAD and AP.

Based on my understanding once 485 is filed, one can only get one year H1b extension it does not matter if one uses EAD/AP.

Can you make what you wrote here in your reply in a form of a letter and create a petition to be signed by IV members ( just like this petition fighting Lou Dobbs). then your petition will be mailed to all media outlets. I really like what you wrote and I think if baked by IV we can sign it as a petition and send it to explain our cause to the media and the American people that might not be aware of our situation.

- Despite the fact that they pay taxes, social security etc
- They represent a continued American heritage of immigrants chasing the Great American Dream
While H1B workers might appear to 'displace US workers', the crux of the issue is that in order for US companies to remain innovative and competitive they cannot afford to take a hoary protectionist policy in talent management.
High skilled talent finds level ground, wherever it might be.
While the old world order was about national boundaries and international competition amongst countries, the new world order is about a flat world where transnational collaboration and commerce can enable wealth and job creation in any part of the world!
The presence of high skilled foreign workers INSIDE the US
- ensures that jobs remain in the US
- ensures that resultant taxes remain in the US
- ensures that resultant investments target the US economy
- apart from ensuring US competitive and commercial advantage
The oft repeated arguments about 'local talent being available but not tapped' is borne out of a sense of elitist entitlement; something that runs counter to the great American Dream and the quest for constant innovation, creation, improvement and execution.
The need of the hour should be on how to enable successful assimilation of high skilled labor and talent into the US economy such that the economic engines of efficient productivity are not hampered by artificial tarrifs and barriers borne out of a broken immigration system.
The quest for a color-blind, talent-oriented, country-agnostic immigration system has a long and sometimes troubling, history.
While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.

Thanks, you are right. It's like the water bucket analogy. Put your hand inside the bucket, and then take it out, and you won't see much difference in the water level. That's how expendable we are to our employers.
A lot of people are indespensible based on employer needs and competition and skills. So you just have to find the right employer and concentrate on your skills.
Companies like MSFT and Google believe in retaining employees at any cost and taking care of employees in best possible ways. But getting into them will be competitive.
So it all depends on a lot of factors, company finances, employer attitude, bad luck, bad time, business going down, bad managers, problems in departments, co workers issuees, consulting company blues, immigration issues etc.. ................
The chances that someone goes through this situation is 100% and remember no one is "despensable" or "indespensable", it is all about how resistant you are to changes

Buying a house is a risky proposition on H1 specially considering the fact that if one is laid-off and needs to relocate within a short-time then one may end up loosing money. Besides getting into the hasseles of home maintainence is trouble-some and expensive and probably not worth the time and effort if one is uncertain about their future in this country.
Having said that if an individual is good at taking calculated risks and has a secure job then rewards are truly exceptional. I would rather wait atleast till the time of filling I-485 before making any long-term investments in this country. I know lot of my friends are probably going to do the same.

3) H1B 9th year going on.
One good thing I did ,I bought a house in Dec 2002.Now If I sell the same house,I will get minimum 100K profit. I will get good appreciation now.I recommend you guys to buy a house now. It is the best time to buy a house,because it is "Buyers market" now ! You can make some money if you sell it later...

I bought Patriot America by img global for my parents. We had to take my mother to ER. The total claim was close to 10k and to my surprise imgglobal did pay exactly as whatever it said. It is not a pre existing condition. Based on my research, nobody covers a pre existing condition.
The advantage of using the american, comprehensive policy is, the hospital took the insurance card, no questions asked. Send me a PM if you want more details as it was really painful in the first place to go to ER, let alone worry about insurance.

Friends,
I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

There is no leadership problem in core : not a single thing, nada, zitto, zapata. Core has much better info for decision making then any non-core; the decision may be interim relief (I-485 filing, unused visa recapture, ...) or any thing else. My conclusion is based on my readings about immigration issues, our issue, current political situation and core posts. Core has correctly predicted Ag Jobs and Schedule A this month. We are wasting our time by debating this issue. Please educate yourself.
Core has not misused any contribution money; it is not easy to misuse contributions made to non-profit organization. Once again please educate yourself. Besides, how much contribution money is there? However, I have very serious problems with members when Aman says that he has spent 30-40K of his own money and logiclife says that he has spent his own money on travel : shame on all members who are still sitting on their $20 and debating all other issues.
I do have some issues with core. Some members are curious about finances and progress reports. It is much better to post such info (decided by core) rather then wasting time when someone asks about. At present, such info has been posted and is the best info available at this time.
I also have some issues with deleting posts. Based on the contents of deleted posts, I don't think the core has much to hide. Hence, it is better to let these posts exist rather then delete them. Members who agree with these posts should be free to debate. They will not hurt IV. Deleting posts has undermined the credibilty of core.
IV was founded by some some core and exists only because of their efforts. They have earned the right to make some decisions. Please understand that, everyone makes some mistakes and has some bad days. I request non-core to give then benefit of doubt on side shows and freak shows. We are wasting our time on these issues.

1. Where is the money for the lobbying firm?
2. Whose problem is it to arrange money for the lobbying firm?
3. How does discussing any issue in the forums help us in arranging money for the lobbying firm?
So non-core, please don't worry about core. Worry about yourself. You are doing a great dis-service to our cause by debating anything not covered by the folowing.

There is a weekly conf call with attorney Prashanthi on thursday 9 pm EST. In one of the calls I had this question and the answer is that once you use AC21, the most recent company were you are working and where your GC got approved will be your sponsor so u have to stay with that company for 6 months ( the time duration is debated in other threads)
