    Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

    CIR is a heavyweight bill. Heavyweight bills passed hastily leads to heavy indigestion. Look at the parliamentary history in US and India. We need lite weight riders and hitchhikers. Pushing on CIR is betting on a horse that is soon to be retired, with masked broken limbs..

    Next move for EB should be THE decisive, concise, striking at the heart and quick. CIR is not the best bet for that.
    Somthing early spring would be the ideal thing to expect before the political capital is lost by the new congress.


    Was just watching Late Edition on CNN..with Arlen Specter and Chuck Schumer.. Specter did mention that he expects the CIR to be passed in the next few weeks in the lame duck session by the house.. infact he mentioned that the conservative outgoing speaker Hastert in favour of this at this time..so house might pass this now..with the senate already passed this..

    Lets see who this goes ..

    Sameet and others,

    I checked with both pediatrician and Civil surgeon and they both are of the opinion that TST test would not impact a nursing mom.

    My attorney told me that my wife needs to get back before her scheduled trip. This would incur huge costs plus it would be difficult to get the seat arrangements. ( We have a twins and we have seats with bassinets for the infants). My father is also travelling with her.

    Is it possible to ask 1 month extension for RFE based on the difficulties. I'm EB3 IND PD 2003 and I dont think our I-485 is waiting for adjudication any time soon.

    I've scheduled an infopass appointment tomorrow. What are the chances of getting an extension when I present my case to IO?

    I'm worried and it makes us very anxious.

    Hey, sorry for your situation, I can only imagine, I cant even manage one here..:rolleyes:

    pun aside, here is my 2 cents

    1) did you talk to your lawyer?

    2) if # 1 is ruled out or of no use, I would personally draft a letter showing that she is travellling right now and with kids and it would be extremely difficult to get her TB test done as you cant get it done by that RFE due date. add some more stuff telling your situation as to why she cant come right away due to the stuff you mentioned (kids/babies ). IAm sure you WILL get it exteneded.

    I don't know why but we tend to be satisfied with lsmall benefits...
    I agree with you "something (EAD and AP) is better than nothing"
    But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
    I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..

    What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.

    I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.

    After you apply for AP its only 1 year H1 increments.

    What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.

    We had a small revolt (peaceful way) and its successful.We dont want to stop there.

    LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING

    I hope you guys are with me..looking for your comments

    H1B problems have nothing to do with retrogression.

    If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?

    Nothing.

    Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.

    But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.

    At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

    U have the point.

    These issues are not causes for retrogression, but these issues make it difficult to fix retrogression.

    IV moderators and members must not encourage things like "ABC company not paying bench salary for my wife though he took 3k from me to file for h1 and is holding her paystubs etc"" These are the things that will make it difficult to fix retrogression - in these kind of situations it is both employer and employee at fault.

    so let me understand it, you are saying that you don't agree with something that's why it has got to be wrong. Its not wrong because it is wrong, but its wrong because you don't support it. Is that right? And because you don't support it, it has got to be unfair and that's why its wrong. Isn't that what you just said?


    I made the post there. Since you are making some funny comments along with clarification, not sure if you are really looking for the information. But here goes

    1) Removal of per-country quota: Claimed to be fair for everyone. Not really. It only helps Indians and Chinese. ROW will see a serious degradation in the time they will get their GCs. I am sure there will be lots of bashing based on this, but the fact of the matter is that such action is not suitable for non I/C applicants.

    2) The Rich guy comment is based on the latest (supposedly supported by the CORE no less) action which is to ask for legislative changes if you have money to throw in to buy a house with 20% down.

    So yes, I do stand by my statement that IV is devolving into less than general purpose immigration group.

    I am EB3-India, yet I dont support the removal of per country limits, as there is a reason for the diversity rule, Indians and Chinese are currently on the wrong side of the equation so it seems "fair" to remove the quota.

    Great stuff folks..

    I convinced more people from my office to send a message on change.gov. Even US citizens who respect your work could send a message to the transition team saying that they are for the legal and highly skilled immigrants...

    Getting recommendations from your bosses, managers and co-workers may also be helpful. Its very unusual for the USCIS/Immigration dept people to hear good things about the immigrants from US Citizens.

    These days lots of people are talking about the transition at work and they know about change.gov website. If you know good friends who can write for you then that could be of great help.

    I have a feeling that some good news is coming up in the pipeline. Was reading about Janet Naplolitano and Silos in today's NY times editorial.

    Lets give it a best shot here guys..:)
