Newer version is - as should've been expected - more protectionist than before.
1) It prohibits H1B workers from working in contract positions.There is a redundant provision for the L1 visa as well (there is already a law which does this for L1). However it doesn't prevent American companies from keeping these contract workers in India or elsewhere and co-ordinate the work through web-conferencing, video conferencing, VPN/VNC etc.
The day this law passes will be a great day for Outsourcing, and a sad day for America.

Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.
We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.
I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.
Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... You are right on - most of conversations/analysis on RE market in India (especially Hyderabad which I am familiar with) center around how NRI/IT employee money has spurred the prices. its a big urban legend. Majority of these "investments" were with black money - corrupt govt employees, local businessmen, and politicians of all parties, and ultra rich actors. They saw a chance in converting their black money into white and pumped up into RE projects as "investments". I saw a report somewhere which said that these black-money transactions can account for atleast 33% of RE transactions in hyderabad (with another 1/3 coming from companies/FII's and only the other 1/3 from NRI's + local rich professionals like IT employees/doctors/lawyers etc). In the apartment and SF homes market most of the projects are in the mid-way thru completion -with majority of apartment projects scheduled to complete in 2009-11. During that time there will be abundant apartments with not many people living in them - expect to see rental prices go down even more.
Of course these investors would eventually try to cash their assets - and deman vs supply equations change dramatically to drag down prices. In addition to this - the current global economic conditions are bad (to put it very mildly) - the argument that it will not touch India may not be correct. Our economy is a lot smaller than other economies like US/europe and depend a lot on those economies - more financial companies bankruptsies would affect IT companies revenues. Also there were direct investments from some of the failed companies in India - for example Lehman Bros had a investment in one of apartment project in Hyderabad. Morgan Stanley, Merrill Lynch, etc. all have tie ups with RE companies with huge "promised" investments. Now that they themselves are in trouble - dont think that they would venture into indian RE market anymore - this can also potentially drag down prices.
I could be wrong (was saying that this would happen for last one year - it didnt happen so far ;)) - but I think buying an apartment/house in Hyderabad/Bangalore/Chennai now in 2008 as an "investment" is not a great idea. If the buy is to live there - then its another matter (I never look at my home as an investment - its more of a life style choice whether in India or in US).
On the same note.... On my last trip to India, Hyd specifically...I went around and asked some people I knew for an estimate on a property...I saw people just pulled the numbers out of thin air. I donno how they came to the number, there was nothing to track the real value, like revenue records etc.

@snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

@poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
Seems like there are victims falling for this modus operandi time after time.

IV is a movement. Once you are on it, irrespective of whether you are personally successful, you will be associated with IV. I do not have my GC yet. But surely when I have it, I will continue my association with IV. :)

SBI....
I used ICICI for 7 years....was always ok with the serivce ...did not have anything much to complain....
I did not know about SBI service being available....a few days back someone on IV forum told me to try SBI....I tried it out....
If ICICI charged me 50 paise per dollor SBI charged only 25 paise per dollor....(come one it is not free with anyone... -;)
I used SBI twice so far.....quite happy.....more over feel glad to use a nationalised bank -:)
compared to ICICI ...on a different note....my wife opened an NRI account with ICICI 5 years back and since then I have been trying to add myself as a joint acount holder....starngely ICICI's "excellent" customer service has not yet been able to do it....:confused:....I might as well give up....lol...

You needn't have a rejection to be part of the lawsuit.
You can pretty much rely on their revised bulletin and convince the court that your application was/will be rejected and be part of the lawsuit.
I guess USCIS is getting pretty smart. To be a plaintiff in the lawsuit, your application has to get rejected. By holding your application, it is probably preventing you to be a plaintiff. Smart F***ing A**es

There was a topic where googler had explained that as per DHS employee, unused Eb2 Worldwide goes to Over subscribed Eb2, so Eb2 India and Eb2 China.
It appears that the policy was always this, but since there were no excess Eb1 in the last couple of years, there was no spillovers in the last 2 years, howeever this year there are higher number of unused EB1.
In fact the way it appears is :
EB4 unused ==> spills over to ==> EB1
EB5 unused ==> spills over to ==> EB1
EB1 unused ==> spills over to ==> EB2 world wide.
EB2 Worldwide unused ==> spills over to EB retrogressed.
So before any spill over to EB3, visas are given to EB2 category.
Since the unused EB2 visas are given to retrogressed countries, I believe that more visas are used by country that has more retrogression. But if there is any future movement in EB2, than both India and China could experience it.
From www.immigration-information.com forums, it appears that one of the important driving force behind the visa usage is the actual adjudication of cases from USCIS. Since generally USCIS does not really process enough cases to use all visa's(to ensure they are not wasted), every year there will be a need to have substantial movement in the cut off date to generate more demands for visa's, not just in AOS, but also CP.
