You should have seen a stagnating US before the 90's. Didn't know what to do or where to turn.

In this case the guys as he "claims" appears to have come here without employer calling him. And is trying to complain against. Who will be screwed up. The employer can easily say he anticipated, but no project no, so didnt get the guy to US, as its legally allowed not to get.

Robert, you are WRONG in your position. Actually it is not my vision of situation, it is vision of the USA law.
Empoyer MUST HAVE WITHDRAWN H-1 if H-1B job was no longer available and he DID NOT. He did not promptly respond to the employee, so employee had to stick to the pending agreement and COME to the USA on the designated date, for his own money.
After employee came to the USA employer benched him unpaid, still not revoking H-1 or paying salary as he is supposed to do by the LAW.
Now he must pay employee's tickets to and from USA as it is also required by LAW.
Probably it's kind of costly for just "silence" in the email, but it may be VERY costly for the employee to come - as he may had to end his lease in home country, cheaply sell furniture or have other damages connected with this travel.
Also there is still a possibility, that employer is a fraud, who takes $4000 from employees, applies for visa, and regardless of it being approved or not keeps $2000 from every such application. It's not that little if he applied for let's say 10 or 20 employees.
So I think Alex MUST report the employer to DOL.
Alex should also file police report to check if there is a fraud going on.

I dont know if that's completely true. I had my H1B visa appointment on Dec 28th in Mumbai and am in the PIMS verification status also. The visa officer told me that all NIV applicants around the world have to go through the process and admitted that the process was new.
I talked to 3 other H1 candidates right after I was handed the yellow slip and they all had the same experience with different officers. Although its aggravating, hopefully, we'll all get some relief this week.

At least for the consultation phase hire a good lawyer, there are scores of lawsuits filed each year but as long there was no life threatening injuries in an accident you can get out of it. This should not be a criminal conviction and should not hurt your gc process. Again I am just assuming the back up ended in some dent to the other persons vehicle or were they walking and you hit them there were injuries involved.

What is confusing is that in the notice of intent to deny; uscis officer stated that person may be eligible for ac21 and to give a job letter.
The only thing I can think of is that there may have been something wrong with the I-140 (ie., too many cases file by the 140 company and company revoked it in response to an ability to pay query, etc.).
This particular company is pretty large staffing company. i do not have any interaction with them but from what I know; they have been cancelling a lot of people's h-1b's and telling them to find other employers to transfer to. Don't know if there is a story within a story.

[LC/Approved I-140] ? Yes. It was LC that was pending with my previous employer. Were you paid the prevailing wages mentioned in the LCA of previous H1B ?

Many folks suggest that this BIll (when turns into a law) would promote outsourcing..but how does these set of changes being proposed by Odama's admin. would affect outsourcing??

I know it wont "stop" outsourcing in any way but seems like they claim that they are " taking away the tax advantages of companies shipping jobs overseas"...Iam sure its more complicated than that..
However the kind of tone being set by the incumbent these days, I believe reflects the current administrations policies that might trickle to us(documented workers) as well.. not sure..
However this can be also looked at, the adminstartion si trying to "show" that they are doing whatever they can disccourage companies from sending jobs overseas..and then eventually take a stab at CIR..wishful thinking..:D

Not sure if it prevents outsourcing or not. It will have a significant impact on all fortune 500 companies incorporated in US. it would encourage companies to be incorporated somewhere else and set up a subsidiary in the US, so that international income is not taxed.
Exposing tax havens is one thing, but taxing income of corporates generated in another country another.
I think a government should only tax GDP produced within its borders and income of people living within the borders. The benefit of being incorporated in the US is usually that of access to capital markets, but in a globalized world even companies incorporated at other places have this access now.
Overall this is a good bill(esp when applied only to individuals), a lot would depend on what gets passed finally. For corporates the high tax rate is very high(35%, deductions bring it down to an average rate of 25%) and while these deductions are removed, the top rate has to come down, something which seems to be missing.
My view is that with regard to taxes, rather than a fix here, a fix there and making taxes more complicated, it would be better to just simplify it as a whole, abolish most, if not all deductions(keep deductions used by most 90% people which are few) and charge a fixed 15-20% of GDP (with some progressivity).

Look at the previous post. Its a myth that NRIs are buying up all these high end properties.
Indian real estate market is fueled by the black money india. They are using NRIs as a facade. Investing in realestate legitimizes that money. Now they don't care how much rent they are getting. It makes no business sense at all. You and me cannot comepete with them.
Assuming you are correct. The black money needs to be converted to white money. So they need to sell the apartment at some point in future. There is no point in letting it sit there with low returns. If all these properties come to market the effect is the same. It drives down the price.
Otherwise I have to conclude that these guys want to repent their mistakes and doing community a service by buying properties at sky high prices so that ordinary folks can rent it and is made affordable. :)

I dumped H1B, and even renewing EAD myself. Keep on giving I9 form.
This helps me to keep interaction at the minimum with Desi Employer.
Now that you are on EAD, what is your plan of action if your I-485 is denied (for a valid/invalid reason)? What do you think of (1) above?
