Now that your H1B from new company has been approved, they must have reopened the old one to send the notice to lawyer requesting them to confirm that you no longer work with them.
Anyways since ur new H1 is approved you have nothing to worry... chill and Njoy

Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)

I moved out to consulting company and now work on %age and now I don't really care about being artificially loyal to any client. This is more healthy, resume gets built and you do not have to worry about losing your visa and status as long as you are in project, and as such changing projects is not difficult these days.
Most of the immigrants tend to be artificially inclined and have love and affection towards their companies just because Green card process is going on. Companies love to be cuddled by you but will not go out of their way for you.
The very reason logiclife and other folks started this group is because we are on our own. It is a fact that we are at no advantage with retrogression. Offcourse there are choices and one always has choices. Keeping quiet and accepting crap is not right. Whether we succeed or not, we must not accept crap as "fact of life". There is a saying "If you can walk, you can work".

Guys.. need your expert advice.
I am travelling next month out of the country for a week. I am currently on a valid H1B which is stamped on my passport but my 485 is pending and the dates are current. I also have a valid AP to use and return on.
Question i have is if i show my H1B visa at the port of entry and enter using that am i risking my 485 application in anyway?
Let me tell you the hypothetical situation i am talking about
lets say my 485 gets approved on sept 6th 2008 but has not been updated on the USCIS case status online. Also i enter the country on sept 6th 2008 on h1b status?
What happens then? do i lose my 485 status because the last status i enetered on 485???

Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

"...Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.
....Just be careful with the idea of "demanding" and "rights" though :)

I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."
Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.
And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...

i agree with ash0210...there is a lot of "money" discussion going on lately.
The idea should be to convert thus-far-non-contributors to contributors - not to make closed forums - you wont expand the market that way. The 3 month trial idea is a good one - but people will find ways to abuse it also.

I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.

You probably can't ask to stop portability from EB3 to EB2 or EB2 to EB1. But you can ask for if filers from EB3 goes to EB2, they can't keep the PD from EB3 but get a new PD for the date USCIS process their EB2 application.
That will make people really think if that is worthy to do so. Otherwise every EB-3 filer will want to file again for EB-2 if they can.
