Dear Friends,
Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

Well, you did not give your easy example, nothing about affirmative action, nothing about representation or overwhelmed by Indian and Chinese thing, and absolutely nothing about preferential treatment. So in-effect, you totally skipped the entire debate, I guess my trick played well, you are now overwhelmed by Frank Caliendo, just as you are overwhelmed by Indian or Chinese.
And while you "hinted" that we are all equals, you did not say - if we are all equals, then why should there be PREFERENTIAL TREATMENT for one group of people over others, unless someone is still practicing APARTHEID. Last time I checked, practicing apartheid is a crime in US and it can land you in jail, not sure if you knew that.
And while you continue to apply for your green card, you are still charging "India" for that because as per you, your country of charge-ability is India, right? Sanju, I did not promise to give you any more examples - easy or otherwise. People have made up their minds, and arguments against the stand devolves into character assassination. While I myself dont care about the dots, and seeing that the discussion started off, at least in part, about unscrupulous distribution of dots, I find it very ironic that I am getting insulting words thrown at me. Either these people cant understand irony, or they really are just learned "angootha-chap", or they are addicted to red-doting people (pretty much bringing the prophecy of the original poster true).

The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.
So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

I don't think H1B is law is that complex, it just says to get some skilled foreigner to work if you have a position (contracter/fultime/parttime or whatever it is) to pay for that. Thats it. So any US employer can apply for H1B by declaring his will pay the wage mentioned in H1B LCA.
H1B law too broad. It didn't filter any. Thats the reason some are abusing it.
To the best of my knowledge (correct me if I am wrong) H-1B can not be applied for contract worker if the visa has to be applied on demand and bench is not allowed.

I called the local senator's office (Maryland) and they couldn't give me a response. They claim that they don't have access to the information on a bill status if it is a federal bill. But if I call the representatives from California, the office asked me to call my local representative for information on bill status!
The only house bill with a Senate version is HR 6039 (26 co sponsors). However the corresponding senate version S.3084 only has 2 co sponsors.

I have come across some cases where GC aplication I140 was reopened after being approved. So this is no surprise. While I could not find the reasons fully in many cases, why cases were reopened as people tend to hide the true reasons. I think for GC applications the reasons may have included-- suspicion of fraud/complaint against the employer/Ability to pay after seeing more GC applications in the same company and thus reopening past cases/Bona fide intension of the employee to join the company after seeing some irregularity in the immigration applications/too many GC applications or H1B applications from the same company and thus a red flag for an H1B dependent employer.
The best solution in such cases is to first find out the reasons and weakness in your case. Each case is different and one cannot generalize. So each applicant will know their reasons. If the case is reopened, then don't panic. But if you get an RFE, the immediately contact a good lawyer and answer it.

But an H1 which was approved an year ago, I have'nt heard of anysuch thing.
There has been no fraud, mis-interpretation, complaint on my part and the niether did the law firm nor the US insurance firm...I am confident about that....
Lets see what the notice says..and I will update everyone of the findings...

Even if we did, there are no tangibile benefits for us at this time.

As long as people support the cause and organization "Willingly" we will have infinite horizons to grow. The moment you bring "Burocracy" in, ultimately momentum will die.. may be slowly or quickly. Historically, IV threads are the major attentive media to declare the existence. We should not kill that with any enforcement of "Paid membership"...It is always hard to wake people. If that would be easy than nobody would have used the word "Struggle"..right:). On other hand yes there is a dier need of increasing financial strength exponentially and that too quickly is at high priority. We need to think and find other ways and resources.

I think one thing we all can help is with clearing myth from American people mind that immigrants are hired on H1-B visa because they work for less $$. When few of my friends were hired to different companies, we all got lot more salary than American hired at same time for 2 reason: MS and education background.
Also, it cost company a lot of money to Sponsor H1-B for its employee. So if immigrant is hired, he/she was the most suitable and required candidate (Atleast at that time).
I think we need to work towards clearing this concept from American people mind for favorable wave for legal immigrants.

I have started taking printouts of the instructions and handing it to people - hoping that will increase the probability of them calling.
Great idea. Thanks for doing this. As we know from our admin fix campaign, our own members sometimes do it as soon as you hand out a hard-copy!
Also folks please don't feel shy to speak to these reps or their aides. On the other hand, please know that they respect you a lot for taking the time to call them and let them know what you feel about an issue.
