I second that. Who knows to accomodate these cases judge might ask congressional approval for recapturing the lost visa numbers.
I think it's better to file now, if your PD is recent.
Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.

Steady march!, not fast march!! ;) I am very hopeful of the dates moving past mid 2002 for FY 2009. (which is about 8 months movement from now, and I think that is very possible).
I am thinking we have about 5-6% representation for the earlier years on this poll? What is everyone's estimate on the representation??
abt 5%. I think people from 2001/02/03 must have got so much frustrated that very few of them even check the visa dates, forget about checking IV regularly.

That's interesting...from my visits to various threads and from wait times of my friends (3 to precise) who recently got naturalized, the average time after receipt of N-400 to taking oath is around only 4 to 5 months.

From my visits to several naturalization-related threads, I have rarely seen anybody who became citizen under at least 1 year, going as far back as 2002. You are right, we won't expect another rush now as it was in year 2007 (compare the "Total" number naturalized in 2008 with that in 2007, Table 2, page 3, here (http://www.dhs.gov/xlibrary/assets/statistics/publications/natz_fr_2008.pdf)). I am desi also, but I hate these consulting companies who do that. I worked my a** off to get a full time job, never faked my resume. People in this forum who blame it on the system are as guilty as the desi companies. Come on people, who are you all kidding, can you commit a crime and balme it on society/system for it? I totally agree everbody. ICICI bank all time sucks. I have account with them for 5 yrs. and everytime I do transfer money to India (FYI I do Wire Trasnfer On Monday morning US CST only should be credited in 1 business day, expected that the money will be credited by Tuesday IST ICICI Business time). What happens eveytime they will credit after 5 business days and provided with lowest Exchange rate.

When I used to live in Canada, and before all this Nuke fiasco, I could do this, and the way I got away with losing minimum amount of money was that I asked my bank to transfer, say, 2k in US$ to Iranian bank to be held until my dad went to collect it. He got $2000, with no subtraction, rate conversion or anything. He could sell it to the money exchange shops at the rate of the day. You should try doing that (Send US funds, instead of doing the send & exchange through the bank which has a vested interest in this...)

Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.

If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.
that may be the case...but maybe the guy couldn't afford the 4 year engg...did the way way cheaper 3 yr bachelors...then worked ...made some dough...decided to study further to advance...so did MCA ( repeating a 4 yr bachelors is not sensible or economical at this point)
This is all speculation ofcourse...the point is we don't fully know the person's circumstances and should not judge based on face value of the degree...if the person is talented he/she will be retained by companies who want to keep them.

Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision,like the amount of the tax you pay, your political view, your education level,etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.
Oh, come on. I think situation is much more simple than that. I wonder if FBI really got ONE bad guy among H1b poor souls. FBI perfectly knows that it's just stupid to suspect a person who lived on same place for years, personally went to fingerprinting, submitted all kinda information about himself and humbly waiting for GC in being some "threat".
Because of that FBI considers us "low priority", simply - they don't care about us. But the law requires them to check us, so those who got "no match" automatically pass without any human intervention. But those who by some reason "matched" are awaiting for some FBI dude to push couple of buttons on his computer. But since FBI dude will be first considering more important things to do, those couple of "button presses" might take couple of years.
This is how I see it. If that's true, then ironically if some of H1bs would be involved in drug trafficking, prostitution or would really posses any threat - namechecks would be going really quick.

now we know the reason for my wife's RFE. They want to prove the validity of her marriage to me. We were married only for few months before we applied for I485 ( july fiasco ). My attorney had asked for few documents. Let us see how it goes.

I do not mean to be negative, but this immigration debacle does not seem to end. How long do we have to freaking endure this nightmare? IV has been trying for months now...When do you think we will have immigration relief? Are we just going to end up being like thirsty deers in a desert chasing a mirage in search for water?
