    Excellent point. It is called the Selective Service System (www.sss.gov), used when the President orders a military draft (like the ones during WW2 and Vietnam war)

    You have to register (males only) if you become a Permanent Resident in the ages 18-26; otherwise you could have problems during naturalization (N-400 has a specific question for Selective Service) and securing Federal Student Aid.

    In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
    AFAIK:

    AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.

    The above is just FYI.. You can google for more info.

    AC21 is a law. AC21 Memos issued are guidelines that IOs are supposed to follow. E.g. If one IO issues NOID if I-140 is revoked and another denies I-485 directly then the latter needs to explain why he/she chose to not follow the memo. In any case, there should be consistency across board to follow AC21 regulations.

    What you guys think about On-line MBA ? Is it worth doing ? Any recommendations for on-line MBA or on-line M.S.?

    there is no difference between online and regular MBA. some universities who have bith , do not even differentiate it in the diploma. for experiance people who add a MBA it has some value if they seek higher position. if you go on to to brick school you could get selected in campus interviews but the position is also lower

    I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.

    About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he is a lying, cheating bastard who changes his story all the time.

    angelfire, before you go and make such a determination, please do understand the root cause of the issue.

    EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
    Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.

    Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.

    Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.

    How many are actually converting?
    humongous EB3 number stuck in 2002-2003.
    handful people actually converting due to risks involved.


    That EB3 people should not be made to start from scratch all over again, however they should also not be given the advantage of a loophole in the system. We all knew the evil of LC sub and this is something similar to it.
    However I do sympathize with the sense of desperation and hopelessness that people in EB3 feel when they don't see a light at the end of the tunnel.

    There will always be condescending comments made by people on the other side of the tracks. Heck, I've heard some comments that completely put me off from taking part in IV and helping people who already have EAD (I missed the July 2007 orgy). But it is what it is, we either sink or swim together. If you see how many characters in Indian MNCs take advantage of the EB1 MNC executive category, you will be apalled.

    Ignore and focus on what needs to be done would be my advice as everything somebody who is not a decision maker in the path to immigration is inconsequential.

    H1-B has the following advantages under certain conditions.

    1) If you are not yet married, you dump H1 and you are dumping the ability to bring your future wife to US immediately after marriage.

    2) Some states give driving licenses that is valid until the EAD expiry or H1-B I-94 expiry. With H1-B, your hassle of DL renewal is reduced to one third of EAD based.

    As I mentioned in one of my post not even 100 persons responded. It either means there is not much persons who are impacted by the memo or most are not interested. For many people to participate they will need to know the details and directions. But most update might be in donor forum. So I think in future IV will get good efforts from only donor members. But if enough donor members are there then that will be ok for IV to get success in any drive. Otherwise it will be tough as there will not be enough people for advocacy efforts

    But this drive might have added a few donor members. In that way it is good.

    I am in "Not in H1 and not affected" category but willing to contribute both time and money for this cause.

    Please count me in.

    Not only is this memo discriminatory this kind of news (some folks call it rumour) has been going on for almost an year and no one bothered to believe it until this memo was released and few good attorneys like Ron Gotcher (followed by others recently) have openly posted news on Newark aiport and openly condemned the memo

    Please stop arguing and lets all work together for all H1Bs(remember most of the folks entered the US on this specific visa type and now its pay back time). Do not fight I am L1 or EAD etc. Sooner or later it will affect all...Its coming ..so act faster now. If this continues for a while - majority of the smart folks will prefer to move on.

    This is just my interpretation - US is no more the US it used be and attitude towards potential future immigrants (specifically for one country) is certainly changing..

    One more to add - I do not want to deviate from the main topic but would like to share my comments. Stop/Delete all threads on compaints from H1B/EAD folks on public forums(example: employer not paying what should I do, No paystubs what to do, how to enter the US with status issues) we are actually feeding the beast with all these topics..hope everyone understands..As the situation is changing we need to change accordingly.

    I guess you are talking about premium membership like wsj etc. I am not sure a free exchange of ideas can occur if we put our membership for sale by restricting access to some parts of the website. IV will lose some of its sheen and I am not sure the tradeoff in membership $ is worth it- dunno just doesn't feel right in the gut

    that IV will loose members if we force a fee. I beg to ask what other choices you have? Enlighten me. please..........

    A lawsuit should bring things back on track. This is what happened in Jul 07. If it was not for the lawsuit dates would not have become current for Jul 07 filers. I feel there is pretty strong case here considering there are so many people who faced the same thing.

    Guys there is no doubts if you have an opportunity like where employer is paying for the Green card process, I guess everybody should get out of the EB-3 mess. If you stay in EB3-I then you are the last one to get the VISA. If you port it to EB2-I then you put EB3-ROW behind and you get in line first in EB2-I bcoz you will have older PD.

    Very good times for outsourcing even more !!! The Indian Tech companies must be VERY happy.

    Faulty Immigration Policy (FIP) : I am mighty FIP, I am going to decrease the H1 quota.

    Industry : Okay , well, what can I do :( , Well !! If worker can't come to work.... How about send the work to the worker ?? :) ...Outsource !!!

    Indian IT companies (IIC): We are glad to do the work. We have enough resources to ramp up and ramp down. we can send people on L1

    Things are going well for a while ....

    FIP : How dare they use L1s, I will make it very difficult to them. From now on L1 is tightened...Hehehehehe:D

    IIC: Okay I need people to go to US for knowledge transfer, understand the requirements and implement S/W , let me apply H1s enmasse.... else I may not get a chance..

    FIP : Errr , They are using all my H1s , let me tighten H1s even more, How about I charge $10000 for each person coming in. This must teach them (IICs and those out sourcing) a lesson.

    Industry : I cant find any body here, and it is expensive even to continue my employees who are on H1. I need to off shore more work. Hey IIC , I need some one here for understanding my requirements.

    IIC: Sorry sir, I cant send any one to US because it costs me $10K to begin with , and even if you are willing to pay that , there are no visas to any one. Gates of US are closed.

    Industry: Okay I will send Bill, Dave , Frank and Amy who are our business analysts and managers to India for a month, they will walk you through the requirements and come back again for testing.

    IIC: Okay , Indian Govt will be glad to give them visas.

    India : Good, Instead of my sons going to US and spend all their money there on cars, houses etc, they will earn here and spend here. Other industries are happy too :)

    Many years later .....

    Bill : Amy, we should get there quickly , there are big lines at Indian consulate. Hope we can get in today.

    this must be a change in USCIS policy since in the past the spill over from EB2 ROW went to EB3 ROW and then to India and China EB2.

    USCIS must have changed their policy to help established the cutoff date for EB2 India. so now the spill over from EB2 ROW goes to China and India EB2



    No, EB3 ROW can use all the available EB3 ROW numbers. But the unused EB2 (ROW/Mex/Phil) have been distributed to the oversubscribed countries.

    That's how I interpret that.

    The popular belief was that the unused EB2 ROW would first go EB3 ROW but according to this they actually go to the oversubscribed countries in the same category (EB2)

    I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? Thanks guys

    Lets contribute to the FOIA funding drive and get the right information.
