    Since you can study under H4 you cannot apply for F1 (My wife tried that already) :)

    What if the spouse (H1B holder) has to leave the country for some reason, say for an year? Then how is the student supposed to maintain his/her status?

    So, I don't think that is true. If you get admission as a full time student, then you should be eligible for F1. My husband did this successfully in 2001.

    Please guys. Do not rush your marriage for Green Card. I know couple of my friends ended up in bad marriage experience just becoz they are getting faster green card. Choosing right partner is more important than GC.

    If you already decided on your partner and waiting to get married, then its right time. So my advise, please counsult with an attorney if you are unmarried and filing 485.

    This fellow who wrote this might be one of those arm chair critics who just criticizes everything if it doesn't favor that individual. What a moron. I am sure this fellow is clueless about how much effort is put into to make a legislation.

    There has been lot of work done by many IV volunteers just to get a bill introduced. It is so stupid just to trash talk the efforts put in by the selfless IV volunteers.

    All IV members has to be proud that we have been able to get a bill that addresses the GC backlogs. Hey one year back lawmakers were clueless about EB GC issues. Now majority of the lawmakers atleast have an understanding about EB GC issues. It is a matter of time before we succeed.

    The easiest guage for the success of the IV efforts is to see the response U get from the lawmakers when U write to them about GC issues. Earlier U used to get a generic reply about undocumented workers and broken borders, nowadays U would be getting replies that talk about EB immigration. Isn't that an achievement. As a professional aren't U proud that U are give the respect U deserve rather than getting clubbed with undocumented workers. Ask for U'r self?


    I agree that person is somewhat misinformed in what it takes to get a legislation passed. No doubt there are so many IV members who have put in hours and hours of selfless work to get things moved. They deserve unreserved accolade for that.

    And, for the record, there have been various bills (that eventually ended up in the dustbin) even before IV. IVs major contribution is in decoupling the legal and illegal immigration bills (which again were disengaged in many previous bills, till someone decided that they need to add illegal immigrant provisions to it).

    While we all appreciate the contribution Aman has made for this noble cause and we are thanking him left and right on this forum, that is not the real appreciation of his sacrifice. Just saying thank you Aman; good job is not a real appreciation of his sacrifice by any stretch. If you guys really appreciate what Aman has done for us, please show your appreciation by making contribution. If Aman spent $64000, the least you can do is spend $64 on this noble cause which Aman has been fighting for all along.

    What do you guys say... $64 contribution to thank Aman for his efforts and to show that we are behind him. I already contributed 100 this morning.

    A question -- has IV considered challenging the country quota in court? Because the Constitution forbids discrimination based on country of origin..

    another nice topic to debate....i know that i debated with people about this a while ago and they made good arguments why setting immigration limits/controls by country origin is not discrimination.

    Besides the limit is the same for all countries so very difficult to argue for discrimination

    Wondering why USA citizens does not learn ERP/CRM applications when there is such high demand in these fields . Any thoughts ? May be they are pure lazy ? May be they think that if they are kind enough to study BS/MS that automatically entitles them to such jobs and they need not to put up any extra mental effort to learn some functional stuff .

    I got soft LUD on 4/10 and a hard LUD on my wife's application on 4/13. My attorney recd the RFE today and informed that USCIS is requesting evidence of my marriage to be bonafide.

    My attorney is asking for additional legal fees for replying to RFE. Gurus, do you think I should pay to the attorney or can I just reply to USCIS with evidence?

    I don't think I agree completely. I called all of the lawmakers for the CHC campaign, and while you are right, I spoke to the assistants, they were all polite and promised to pass on the message, which is what matters in the end.

    Lawmakers know that we do not have voting privileges yet, but they also know that we are contributing to this economy far greater than many. I do not remember the source or the thread, but this question was asked before about an online petition, but ironically, that is shown to be not as effective as phone calls.

    If you ask me to sign a piece of paper, I might do it even if I am only vaguely supportive of the idea. But I will certainly not take the trouble to call (or better yet) go to the senator/congressman's office and present my case in person unless I really beleive in it.

    regarding your "saar.. support the bill..." comment, I would not go there if I were you. Thats a whole different can of worms and borders on an insult to a) people who are not from that part of India (or for that matter the world) and b) more importantly, for people from that part of the world who are in this country since a long time and have taken the pains to lose the accent.

    Finally, even if one speaks in an accent, is that the sole reason for a lawmaker to disregard him? Then should a Tennessee senator not listen to someone from New York because the New yorker speaks English in a New York accent?

    Please remember IV may be largely Indian, but it is a meeting place for legal immigrants from all over the world. The same way as India may be "largely Hindu" but it is still a secular country and we have had many great citizens and leaders that were not Hindu, the current president notwithstanding.

    February 2006 - Every time I visit Silicon Valley I'm reminded of a simple fact: American businesses lead the world because they employ talented people. From the top executives at companies like Apple and Cisco to the science and engineering students I'll speak with Monday at San Jose State University, Americans sit on the cutting edge of technology.

    We have less than 5 percent of the world's population but produce almost a quarter of its wealth and enjoy the highest per capita income of any large industrial economy. Americans receive more patents than the citizens of any other country, have the world's best university system, do most of the world's basic research, and take home the lion's share of Nobel Prizes in the sciences.

    As many people working in Northern California's technology sector have realized, however, we can't afford complacence. China and India together now produce at least twice as many engineers as the United States. Both have fast growing populations and high-quality universities. In search of profits, companies have begun to outsource more low- and medium-skilled jobs to these nations.

    No amount of funding, furthermore, would allow the United States to catch -- much less exceed -- China and India's combined production of scientific personnel. We just don't have enough people. Even at our own universities, foreigners earn an ever-increasing percentage of degrees in the hard sciences. Some remain, but many end up taking their valuable skills back home. American companies, meanwhile, have thousands of scientific and engineering openings that they can't fill.

    If we hope to remain the world's pre-eminent economic power,/ we need to produce more scientists and engineers and train them better. One recent study, indeed, found that 85 percent of income growth stems from technological change.

    While every American deserves a high-quality education, we need to target additional resources on the most talented students to ensure America retains its competitive edge. In particular, we need to provide an incentive to all of America's bright, driven low-income students who want to pursue careers in the sciences. Right now, far too many talented students from poor backgrounds drop out of college or shift away from hard science because of the expense. It's bad for the country.

    One program that the president signed into law earlier this year takes the first major step toward fixing the problem. The SMART Grant program, which I developed, will focus assistance on students in science, math and strategic foreign languages who earn B averages or better during their junior and senior years of college. Next year, the California State University system estimates, more than 3,000 students systemwide -- including many at San Jose State -- will benefit from the program. Many will have their tuition payments eliminated entirely and the numbers will rise in coming years as the program attracts more people into the sciences. Thousands more students in the University of California system will also benefit.

    Of course, tuition subsidies alone can't ensure that we'll have enough talented workers. In the coming months, Congress will consider the president's proposals to improve K-12 math education, increase funding for basic research, support high-risk/high-reward applied science projects, and make the research and development tax credit permanent. Fiscal realities, of course, will play a role in any final decision as Congress examines these proposals.

    Silicon Valley companies already do an excellent job recruiting America's best and brightest. Now the government needs to build on its efforts to increase the ranks of homegrown scientists and engineers.

    This guy posted six messages and he got so many green dots. I have only 3. May be it because I am EB3 . It rhymes.... :D

    What some people forget on this forum is there was a guy not too long who was dying in six months and I am sure most of our situations are not so dire. Look we all will get GC, we are AOS pending it is a matter of a year here and a year there. But please do not fight like this, we are a community. We were one group before these VBs and now we fight amongst ourselves. It amazes me how the gora man is still able to divide and rule. Chill and relax....go watch olympics.

    Ok, now give me some greens.I am EB3 and only green I can get is the dots.


    For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!

    I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.

    Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.

    THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.

    Seriously, how much more immature can we get?

    Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.

    Sorry to hear about your loss of PD etc. However, the fact that you survived and still hanging in there shows you will prevail. On an optimistic note, the recently released USCIS data seem to suggest that their PD movement is more data driven this time and getting to your newer Eb2 PD, while it will still take time, may not be as long as previously thought especially in this economy with fewer applicants in general. I was pleasantly surprised to see them maintain EB2I cut off dates into Nov. If they set dates anything close to sensibly, they should never need to retrogress by many months or years like in the past. The article about low workloads at NSC recently was quite revealing. Whatever they say now, spillover will be substantial this year end in my view. Since they have finally since last year started to interpret spillover rules the way they were meant to be used, I think EB2I will be the primary beneficiary.
    I would however have the following advice for you, in the interim while you are waiting, keep on them, follow up every RFE after you respond, follow every fingerprint with a phone call, get familiar with your congressman/womans immigration aide, open a service request if you are eligible to do so. In general get your case organised as much as possible before. If you get information that you were pre approved, that would be useful, but even then keep on them as soon as your PD is current. In general with the USCIS, assume they will make an error, if you can conceive that they will make one and sometimes even when you can't imagine how. I can certainly tell you they are not well organised.
