I believe it was last year(not sure exactly) when USCIS started this new initiative where the AILA members can send an email and "Remind" them that a particular case is current. Basically you will send an email with the subject
EB I-485/SEPT or EB I-485/OCT or EB I-485/DEC (Month of the VB when you will be current)
and the body will have just the A #s

So you guys are saying that because you are on a H1B you are working harder than others? Let me tell you that working hard does not guarantee your job. I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)
I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.
BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?

The amount is extortionate and as long as you do not ignore this it can be resolved I am sure. In all honesty it sounds as if they thought hey we only have two years to sue so lets do it now so it does not look as if we waited till the last minute. Otherwise why would they wait so long to file the claim. Herniated discs do not appear at a later date they are a thing of the present, i.e. at the time of impact.
With regard to your green card I cannot imagine it will have any impact at all. You have not committed any crime, you had an auto accident. I applaud you for starting this effort but the petition needs correction, You are calling Lou Dobbs of lying but all the instances you quote are from Sen Tancredo . You may accuse Lou Dobbs of supporting these lies by letting them stand unchallenged not correcting them.

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment? :)

You are in the category getting preferential treatment, so you oppose any change, you "create" arguements that you were "promised" a system when you came, and thus any change to the system, before you get your green card would be WRONG and UNFAIR. So you should continue to get that PREFERENTIAL TREATMENT. And PREFERENTIAL TREATMENT to you is NOT WRONG AND UNFAIR. Right?

Is it advisable to have a GC holder/citizen as partner?
What form of income should i withdraw(salary/profits/dividends/Interest..) How is the income considered when i file my taxes?
I am not aware of anyone who can sponsor my H1 as a trader atleast for now, if i get the right opportunity, i am open for that

2. If you form a llc you become a employee of your own company (say managing director, CIO etc) and sponsor your own H1.
3. You can have a fixed salary and a draw, which is what a typical trader gets. Draw is a percentage of the profits you generate by trading.
4. You don�t need a gc/Citizen as a partner.
5. The company/fund makes money by trading securities and the earnings are retained by the company, you draw salary and bonus.
6. You file taxes as a regular employee would.
7. You might be able to get H1 from a day trading firm, a day trading firm is not a market maker. They trade company capital and typically you have to post some risk capital based on which they will provide you leverage and provide you with equipment etc. You don�t get a salary, just a draw.
But let me ask you something; I am not aware of your expertise in the markets so forgive me if I sound patronizing.
1. Do you have a seven figure capital pool? You will need at least 1MM if you want to make a living trading.
2. Are you aware of the equipment and ECN and direct access software needed assuming you are technical trader.
3. Do you have a prime broker who is going to provide you leverage and settlement? If you have not decided consider Interactive Brokers.
4. What kind of risk management software will you be using?
If you are in the NY/Nj area I suggest try day trading at a firm posting risk capital (typically 10K) then decide if you want to do this full time. It will also help sharpen your skills. If you want I can recommend a few. They will not sponsor H1 though, you will have to have some consultant do that for you.

My mistake.. I was under the impression that my contact info is visible. I have already met with my local congressman and submitted a memo. I have got a reply saying they would address this issue as part of impending CIR bill. I was not sure what to make of it, whether he is pro and anti retrogression..

Get in touch with other state chapter leaders that are active (paskal, janilsal, varshadas..etc) for inputs since they are also meeting lawmakers. It is a community effort and everyone needs to make some efforts in order for us to succeed.

Dude, You might be a new entry in to the ball of Immigration now. As said earlier , every one is free to judge and post the queries. If IV is shutting door of any questions you wouldnt have seen forum threads. There is enough discussion and direction taken on information being released to ALL members. Why one should complain IV not doing anything ?
here are some atleast, immaterial you agree or not:

2. whole of July fiasco was a win becoz of IV , not sure whether you are in the boat, but i can see the pain and how IV helped all of us.
3. all the admin fixes were co-ordinated by IV ,
4. The list goes on.. those 3 above are just enough to prove the help an ORGANIZATION did with minimal resources. Also please note none of the core are full time IV , they are also ppl like you and me.

Raji - I don't know how long you have been around since you just started posting. If you want to promote Family Based Immigration go ahead and go for it.
We all at IV are for EB visa recapture and would want to use our energy and resources for that. IV has done a lot of things for us in the past and continues to do so. In fact IV is the ONLY organization that fights for us.
The last CIR was like a bill from hell for us Legals. You can be very sure the coming CIR is going to be like this too ( with the job enviroment so bad ) . Unless we see something concrete helping the EB community in any bill , supporting it doesn't make any sense.
I don't want the transfer of EB unused visas to FB visa category. As such they already have much more visas every year .

Still IV is posting info to non-paying members , IV Never shuts its door but with limited resources they are doing what they can. Before complaining on IV you do your part. :cool:

Also , FYI... AILA doesnt post all messages to free members .. all the critical info is circulated via PAID members of AILA.. this is part of any organization ... Can you complain against AILA, becoz if you are FREE member of AILA you still get emails like the one reg. Fax to CIR... There is a lot going in background for CIR than many of us even know...

Raji - I don't know how long you have been around since you just started posting. If you want to promote Family Based Immigration go ahead and go for it.
We all at IV are for EB visa recapture and would want to use our energy and resources for that. IV has done a lot of things for us in the past and continues to do so. In fact IV is the ONLY organization that fights for us.
The last CIR was like a bill from hell for us Legals. You can be very sure the coming CIR is going to be like this too ( with the job enviroment so bad ) . Unless we see something concrete helping the EB community in any bill , supporting it doesn't make any sense.
I don't want the transfer of EB unused visas to FB visa category. As such they already have much more visas every year .
