    Anybody has this situation?

    My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.

    As per USPS online tracking record it was delivered July 2nd 12.45 PM.



    No receipt yet. So far sounds okay.



    But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.

    It is a stamp so some of their employee clearly has stamped it.



    Now I am confused if that’s the receipt date they are going to go with and may reject the application.

    And with this many application it may take more than AUG 17th to receive anything back.



    I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.

    And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.



    Anybody in the same situation? Any advice?

    Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.

    If you read (and understand ofcourse), my gripe is not about my lack of ability or desire to file as an EB1, what i was pointing to was the general ridiculous notions being spread that

    a) oh all EB2 India applicants are so "lucky" to have filed it in 2006 and getting approval now, so soon
    b) EB3 India has been treated "unfairly" by USCIS
    c) All of us "deserve" GC asap regardless of the numerical limitations on EB categories, oh this evil system.

    Obsessive compulsive LUD checkers calling USCIS at the drop of a hat are a big part of the problem. If people could understand this simple fact that every minute that an IO spends telling some idiot if his name check is cleared or not could have been well spent in approving a GC for someone else. Every frivolous service request hurts the legitimate ones.

    These forums were started with the best of intentions at heart and they do have useful information BUT now almost everyday, it is the same old story.....same question, same answer (ofcourse followed by the standard ..i am not a lawyer or go hire a lawyer and topped with oh, i contributed xx dollars to the "cause")

    India has produced some of the finest minds in every era. Yet, these forums are more about green dots and red dots; he got approved...why didnt I?; and if someone dares to question, here come the personal attacks....

    It is not fair to expect a member to contribute the moment he joins. It takes some time to understand the impact of GC problems and get a good feeling about IV activities. IV can not post its activities on forums. You will be surprised to know that anti-immigration organizations are well organized.

    However, we have numerous members with 50+ posts and 3+ month of membership with no intension to contribute $20 (you will not get 2 Indian Buffet's in Washington DC for $20; it takes $4 (metro up) + $4 (metro down) + $4 (parking) everyday to DC).

    I (and other members) have literally begged some of these members. One particular member says (s)he is going back to his/her country but starts posting abnoxious messages after a few weeks.

    So, do we have a way to make these thick skinned folks unwelcomed? I dont think any of your postings are less stimulating but I guess there is no big impact on these free lunchers. Is there a way we can atleast discourage them to not use IV's bandwidth and forum to there own benefit. I think Senior Member's should come up with some kind of a solution to this situation.

    Its preposterous that USCIS does not allow LEGAL prospective permanent immigrants using EAD to bring their spouses!!

    Why are you so surprised? If you do get permanent residency then too your prospective wife will not be able to immigrate immediately.

    Looks like this Sheila is in her new avatar, from 3 year degree people trying to make $$$ in others troubles! She threatened to sue IVians for exposing her tricks when she tried to advt her service in her posts, as friendly posts.

    USCIS does not buy her evaluation anymore. Go to her and lose your valuable time and few thousand dollars in addition to your I-140.

    I dont think they will stamp like that...If you show only AP they stamp I-94 based on its expiry says AOS pending or If you show only H1-B visa on PP they stamp I-94 based on Visa expire date..

    But showing both at POE doesn't not give any value and also it might confuses IO..

    Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.

    HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.

    Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???

    However as "Ramba" said in post# 27, it is still a small chance as no one knows what is exactly the CIS rules.

    Here are the answers -

    To begin with first, there are two different things
    1) Document that determines your STATUS IN USA - Your CURRENT I-94 and what it says (stamp/handwritten valid status with valid until date)
    2) Document that determines your EMPLOYMENT ELIGIBILITY IN USA - Your H1-B I797 with Employer Name and valid until date OR Your H1-B Visa Stamp with Employer Name and valid until date (OR your L1 visa with employer name and valid until date or F-1 visa with CPT/OPT) OR Your EAD card (any employer) OR Your Green Card (any employer) OR Your USA Passport (holy grail).

    You have H1-B I-797, You may have H1-B Stamp, Your I-94 says H1-B, Therefore Your Status is H-1B, Your Work Authorization Document is H1-B.

    You file 485, You file for AP and EAD, You get AP and EAD, You haven't used either yet.

    You exit USA, You return to USA using AP.

    Your I-94 now says "Parolee", Your status now in USA is "Parolee/Pending AOS"

    Your Work Authorization for SAME (continuing) employer is H1-B
    A.K.A. NO NEED to use EAD.

    There is NO SUCH THING as H1-B Transfer
    Every H1-B filing is a new one, USCIS checks if
    1) You have valid remaining 6 year period at the time this new H1-B that they have received AND
    2) You have been counted against the H1-B before in the last 6 years or not.

    So now after I-94 says "Parolee/Pending AOS", You CAN
    A) Extend your H1-B with the SAME EMPLOYER provided you have time left in your 6 year window
    OR
    B) File a new H1-B with a DIFFERENT EMPLOYER provided you have time left in your 6 year window AND you are counted in the cap
    OR
    C) Move to this DIFFERENT EMPLOYER WITHOUT filing H1-B by using your EAD.

    in scenario A) your status CHANGES from "Parolee/WaitingAOS" to H1-B with SAME EMPLOYER once you receive your new I-797 that has I-94 at the bottom, you keep working on current H1-B that is being extended
    in scenario B) your status CHANGES from "Parolee/WaitingAOS" to H1-B with DIFFERENT EMPLOYER once you receive your new I-797 that has I-94 at the bottom, you start working on new H1-B receipt notice until that gets approved and then on the new approved H1-B
    in scenario C) your status STAYS "Parolee/WaitingAOS", you start working on your EAD which is NOT tied to any employer.

    Many people FEAR that they should CLING ON TO H1-B "just in case" 485 is denied. Well that fear is not well placed since if your 485 is denied at any point in either scenario A) or B) even though you may remain "IN STATUS" you probably have run out of 6 year clock by then. Conversely, in scenario C) in case of 485 denial, even though you may temporarily become "OUT OF STATUS" you can immediately file H1-B with the working or a different employer to get back "IN STATUS" if your clock has not expired by then.

    between scenarios B) and C), scenario C) is simpler and easier as long as the job is same/similar if you are using AC-21.

    My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.

    Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

    I received "Notice mailed welcoming the new permanent resident" email this evening(Sunday). The only emotion i feel right now, after being in this country for 9 years now, is relief.

    i have an EB2 140 with by current company with jan 2006 priority date.
    i tried to port priority date of my EB3 140 with my old company (Sep 2003) and that worked out finally.

    initially i sent the letter to port date in march 2009.
    I resent the letter to TSC last august. I noticed a LUD on my case after this letter on both 140s.

    some sort of recapture is better than none !!! we should try to have some relief for EB but let us not stand in the way of FB ..the reason is simple, unused FB visas overflow in to EB (if I am not mistaken) ...In fact that is one of the reason that EB2 India did not move much this year since they are more efficient with FB visa this year (see the pace at which it is moving this year as opposed to last year) so better to wait and watch.

    Looking at the table in immigration-law.com, it appears that 33% have been certified and 33% have been closed/denied of the present 67% that have been processed. Those are absolute numbers (it is not 33% of 67% closed, it is 33% of the total 330K). Hence of the 220K cases processed, 110K have been certified and 110K closed/denied.

    If the same trend holds, it will be 165K certified (out of a total of 330K). Add the 1.1 multiplying factor and we are looking at 346K total GCs. This is 2.5 years total. But USCIS seems to be sending off excess EB 1-2 visas to EB3 ROW so retrogression will continue for EB2 India and China.

    There is some massive confusion here. The Immigration and Nationality Act also says the following for EB3

    -Quote
    (3) Skilled workers, professionals, and other workers
    (A) In general
    Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):
    -End Quote

    Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?

    We shouldn't assume that USCIS is too dumb to follow the law..

    This can financially drain you out. My insurance agent told me that they cant get the money straight out of your bank account , because how will they find out your bank account number and the bank? How do they know how many bank accounts you have? What if you send money to India before the judgement is entered against you? If you have a house, they can go after your house or car. What about their own insurance policy? Maybe their insurance can also pay as uninsured motorist pay? Retirement income is usually protected in some states and hence I dont think your 401K is at risk. Once your insurance company pays out the maximum, you can basically say hands up, I have given up.

    AFAIK, the GC job has to be a permanent full-time position and not a part-time position.

    So much pain we are facing in this process. Hope all see their GCs come through fast.
    My attoreny said GC is for full time position and it is very well supported if the employee is working full time with the sponsoring employer. I can easily imagine getting it filed in 3-4 places working part time or not even working. I guess we can run into problems if working part time. There is also a column somewhere in H1B visa application form where they ask "Did anyone sponsor you an immigrant visa". Not sure if that Question comes anywhere in the forms for GC, but if so, what does one write? A list of other employers.May not be a good idea, but its my personal opinion, and I dont have any observation on this

    bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
    and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

    you argue that three countries will dominate immigration. how ever you dont point out the fact or cleverly ignore that all these people were not limited by the system through which they enter but limited by the system only after they enter. Hey we, those from those three countries, are already here. lets implement the country caps through out the high skilled immigration or get rid of them. Enough of your disguise as some one who is logically and rationally for country caps. There is no rationale or logic what so ever in your argument. Perspective. Ehhh! forget that word.
