400k is the unused visas from both FB and EB. Don't know the breakup though.
The number 400,000 (total unused from family based and employment based) in Mrs. GILLIBRAND's website is an estimate as clearly mentioned in the website itself. During last year's recapture bill discussion season, the unused number many calculated and conlcuded was somewhere between 200K to 225K for employment based category.
The bill S.1085 doesn't speak of any specific number of visas to be recaptured. It says that, recapture all (unused visas from 1992 through 2007 + unused from previous fiscal year (2008)) and add it to the current fiscal year.
So, the total should be somewhere between 200K and 225K (or more).

This is definitely scary. I think, we need to kick start our campaign again in full throttle. Last time, we thought, things were changing and we kind of stopped our campaign. There was a Ombudsman link where they suggested to contact them if 485 is wrongfully denied. Did someone contact them?

How do I find out if there has been a Soft LUD? I have an online account on uscis.gov and the "Last Updated" fields are all in 2007 (when I filed my AOS).

How do we know we're stuck in the namecheck process?
Does the on-line status state that the application is in the namecheck 'phase' or something to that effect?

U can either call the 1-800 # or make an infopass appointment 4-6 Months after your first FP. If u plan to call, make sure u call 3-4 times because you might get conflicting info

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
Lets target the 'Asses' asking for a kick. Let's all kick ass.
You know why nothing works ? nobody listens ?
Because H1Bs put up with any garge behaviour, unfair treatment and still work. Once H1B stops putting up with this nonsense and leaving en masse/ stop coming then industry will take a look and wonder that "we need to work on this and improve the situation"
Till then skilled immigrants/H1B will be pissed on like they are nothing.

We all will have to work to make the injustice visible; only then will the employers start behaving.
We all remember there used to be a IV voice member who used to leave abusive comments to everybody. Once we all made a hue and cry about this Pappu took action against him by disclosing his identity and since that day we have not seen any complaints by members.
Yes. That member and probably other such members are now on other site posting anti-IV posts.....
It is shameful to have such members among us.
Anyways, good thread. This site should help people fix the broken system rather than abuse each other or track all day. I hope due to the discussion, people can get some ideas and take action against such employers. IV will be willing to help as needed.

Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..
``(I) the employer with whom the H-1B nonimmigrant would be placed has not displaced, and does not intend to displace, a United States worker employed by the employer within the period beginning 180 days before and ending 180 days after the date of the placement of the nonimmigrant with the employer;
``(II) the H-1B nonimmigrant will not be controlled and supervised principally by the employer with whom the H-1B nonimmigrant would be placed; and

I totally agree with you on this hypocrite Lou Dobbs and also admire your determination and sticking to your views. I too belive that we can make a change if we are determined. I have written my views to the radio station eventhough I don't listen to that channel as I live somewhere far. I hate to side track the issue but I couldn't control my self to accept that Alexander was great( that apprears in your posts) I stongly belive that he was not great but was a coward (I came to conclusion after reviewing the history)
