Dear Friends,
Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years
Wish you all the best ......to everyone who is waiting for GC.
Thanks,
Jimytomy
Awesome...congrats!

Especially since EB3 ROW is not current and it was the overflow from ROW that was supposed to make EB2 move forward ...

Say how many will be Forced to Leave after it passes ??? Remember we are kicked out now -- we will circle back with them after 3-4 years at low cost high tech hubs like Bangalore/Shanghai !!!!
Kicked out or not....I know some of us will continue to work on H1B as long as possible...
What i want to find out are some willing to leave as soon as this bill passes...QUIT JOB and LEAVE?
So that we can get those numbers and these people realize that they are indeed losing something.

unitednations, you making this statement makes me scared.
Shouldn't they release some memo or something before making a drastic change like this???
Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.

Good to know...good job guys...
Just got back from the rally, i would say it was a big success. Media coverage on the issue was fantastic. I saw the ABC7 news truck. There were many reporters from SJ Mercury news, SF Chronicle etc. Crowd was good, dont want to speculate on numbers yet but we should have an official word soon.
Police were very friendly. The crowd was very enthusiastic and also obeyed the rules. All of us stayed on side walks. Logiclife and Frankilin among others were there. Many reporters spread out and spoke to people.
Lot of members from another groups called Immigration Rights also joined us.
We got lot of honks. !!!!!!!!!!!!!!!!!!!!!!!!!1
Great JOB IV and everyone.

This shows that the backlog is more than the numbers on USCIS website. People need to stop wasting time on tracking and spend time in their office work. Backlog means more business money for lawyers and trackers. IV is very small. Unless IV had hundreds of thousands of members, they cannot do lobbying like AILA or Microsoft. EB3 India and now EB3ROW is in a pitiable state. All those EB3ROW who used to be happy will now see the reality. Thank god I ported to EB2 but the dates for EB2 do not move enough. I think anyone who can should port to EB2 ASAP. This is the only solution.

You really think they're in any kind of rule-following mood lately?
Exactly....who the heck are they answerable to..no one.....so expect anything...
Has AILA filed the damn lawsuit yet...what the heck are they doing...playing Tom and Jerry....

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card. How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful. We dont want to stop there.
LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING
I hope you guys are with me..looking for your comments
we seized on an opportunity and won a battle.
the war is still to be one.
there is no way this over. we will fight till retrogression ends.

Is IV interested in doing a Freedom Of Information Act request to USCIS how and when they used up all visa numbers for EB3-India. That might show some information if they cooked the numbers if at all. We might get some more insight which monthly VISA bulletin does NOT give.
Yes I do agree with you. This is a most affected category. As an organization IV can request from USCIS and individually we cannot ask.
All EB3-India filers:
Please come and join this thread and give your opinion.

So a citizen can really help. Please make your contact details available, so that when emergency arises, you can help them by contacting the congressman or senators.
Thanks so much for the suggestion. How can I have my contact details available without posting it on Public Forum?
Meantime, please contact me thru PM, if I can be any help.

understood the anguish,... But will it do any good. No for sure. If not on H1, If not on L1 then outsourcing companies will find alternative like B1/B2 i have seen many examples... if on B1/B2 no benefits at all get the person get the work done forget the "Person"....
This bill will INCREASE Outsourcing.. .My view. becoz employers after reading the text would say why should i worry about filing H1 after all so no new H1 Transfers to regular comps and no to existing consulting companies due to 50% limit. L1's are screwed.
Ask yourself what does it do and whom does it help. Does it help existing economy , looks to many becoz they dont understand it increases offshoring...
But there is already enough abuse in H1/L1 , How is IV recommending path forward for this bill ?

Dear Mr. Craig Johnson,
As a highly-skilled Employment-based immigrant living in Michigan, I am appalled to know a respected bank like Franklin Bank- with a diverse workforce - is sponsoring an anti-immigrant show like "WWJ Business Breakfast" with Mr. LOU DOBBS, which is scheduled to air on Nov 29 between 8 a.m. - 9:30 a.m.
Mr. Dobbs is known for his strong views against immigrants, including considering immigrants to be responsible for the spread of incurable diseases such as Drug-resistant Tuberculosis, Leprosy etc. From past experience on CNN, he is also highly likely to blame the current crisis in Auto Industry to the so-called "importation of cheap labor from third world countries".
He is known to make exaggerated statements such as "Four hundred thousand H1Bs granted in a year" where as facts show otherwise. As per government figures, federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap. These dramatic exaggerations distort the reality and provide a falsified alarmist view of the situation; which works against the interests of Immigrants ,businesses and American economy.
It's not in the best interests of a respected bank like Franklin Bank to associate itself with a blatantly anti-immigrant show, that can harm the bank's image in the community. I request you to withdraw sponsorship of the show in the best interests of your bank and that of the immigrants in the community some of whom may be your workers, customers and business associates.
Appreciate hearing from you soon.
Yours sincerely,
xxxxx

Are you talking about doing this (ability to file 485 w/o current PD) as an ammendment to the Fence act (which just passed House) when it goes to the Senate?

I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.
The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?
Please respond. i am running short of time as i have to travel back to US soon.
I went for stamping last month. It took the consulate 2 days to deliver it to VFS. I collected it at their Gopalapuram office. So, if you had gone on the 5th, it would have been the 7th or may even be the 8th by the time VFS received it. Since you did not collect it at their office, it would have been mailed via courier that same day. Now, it is up to the courier company to deliver it ASAP (blue dart, I think). Call VFS and ask them if they received it from the Consulate. They are very professional. If they have not, then, it is still sitting in the consulate and can be due to this new rule which I have posted in a different thread:

Considering that there are more than 2000 members who havent contributed yet. Even $10 per member wud mean $20K straight away. Common guys, this is tax refund season. Surely we can all send in atleast between $10 and $20. That is cheap change considering most of our life styles. Internet access costs more than that, Filling your car with a tank of regular gas costs more than that. ;)
