I think we need to study the bill in detail before we jump to any conclusions.
From reading the summary in the AILA website, specifically the below :
The legislation would reinforce our commitment to families and reduce current wait times in the family immigration system by:
�Recapturing an estimated 400,000 family-sponsored and employment-based visas that went unused between 1992 and 2007.
Atleast to me it seems like the bill plans on using all the unused visas from the past years and apply that towards the family quota. Not sure if that would help the EB cause.
Inputs anyone?

Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.
That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.
Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!

Mr. Dobbs is known for his strong views against immigrants, including considering immigrants to be responsible for the spread of incurable diseases such as Drug-resistant Tuberculosis, Leprosy etc. From past experience on CNN, he is also highly likely to blame the current crisis in Auto Industry to the so-called "importation of cheap labor from third world countries".

you are asking for EB2 guys in 2004,2005,2006,2007 to wait for EB-3 guys in 2001,2002,2003,2004. Point is well taken. Its a humane way of handling things.
Perhaps they should not make EB1 current, let them wait a year or two while 2004 EB2 and 2001 EB3 get their green cards.
Ask this question to yourself. If you were an EB2 person with 2004 priority with a spouse and kid, Would you be willing to wait few more years to get your green cards so that a 2001 EB-3 shall get his faster and may not care /appreciate your sacrifice?
Your position helps yourself and nobody else. I dont have any problems 2001 EB3s getting approved before 2004 EB2's. Thats the way it should be, but not at the expense of EB2's. Feeling of entitlement is not adequate justification. USCIS has established a way to convert to EB2 status, if you have sufficient experience. You can certainly try that option.

I believe that there is a great flaw in the way the USCIS allocates VISA NUMBERS among EB1, EB2 and EB3 which is very much evident and if we can stand united we can get something done.
After carefully observing the trend in VISA approval and VISA bulletins, It is a reality that EB3-I is not moving and at the same time EB2 and EB1 are moving fast in relative terms and probably may even become current ( EB1 is already current ), But one thing USCIS is clearly not considering is the Priority Date, which basically means that they are not giving a damn thing about how long the person from EB3-I is waiting for. Here is my suggestion and some of the IV representatives need to analyse what Iam gonna say and see if they can stand up. Being an EB3-I india myself, i totally agree that EB1 and EB2 should be given a weightage and some preference over EB3, but I dont agree to what USCIS is currently following, EB2 With priority 2006 getting ahead of EB3-I with priority date 2001. This is ridiculous and to even think about it, it just sounds stupid. What they can do is , They can move the Dates in both Categories while giving preference to EB1 and EB2 first.
Please dont jump up & down before i complete. Iam just giving you an example of how things should work and how they can move dates forward for all 3 categories while maintaining that EB1 and EB2 gets preference over EB3. Let us ignore Eb1, since it is already current. Now Coming to Eb2, the priority Date is 2004 for them.Ideally speaking, They should not move them ahead until atleast EB3 reaches 2004. But once Both EB2 and EB3 reaches the priority date of 2004, Obviously EB2 gets the preference over Eb3 and EB2 will start to move ahead but not by much, let us say 1 year. Now, Clearly, EB2 is still given the extra preference over EB3 but at the same time, we are maintaining the priority dates between EB2 and EB3 as close as possible so that the system is not totally unfair to EB3 filers. I think, as one of the un-biased Organisation we should stand up against this unfair treatment in general. I hope even EB-2 will understand what iam trying to say.

Why are you so PROUD to be an American? Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country

I actually had to go and visit the URL to really make myself believe that someone can be this dumb. Well to each his own.

Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. DOS clearly made this a requirement in OCT 08 bulletin and lets see what happens in the next few months. 2nd Q will be key as the over flow will start to trickle based on demand in EB-1+EB-4+EB-5

I think some of our members put the votes in wrong place.
For Eg : for "Before Nov 01 2002" right now the number of votes are 24 click on 24 you will see which user voted for "Before Nov 01 2002 now check for couple of users for their Labour Approval Date some have labour approval dates of 2006 and 2007

I agree with you. But the reality is you can find only 300-400 people out of 1000s to come forward for any kind of fight. Let it be contribution, send flowers or demonstration.
I don't know why but we tend to be satisfied with lsmall benefits...

But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.

I believe we have rights. If the million of illegals think that they have the right to stay, why can't we? Obviously, everyone has their own experiences in the US. Some of you might not have hit the "boiling point" yet and so you might not have felt the heat!!! There are people who carry the entire family here and they depend on the GC to make a difference in life. You are you and you are entitled to your own interpretation as to whether or not this is RIGHT or Privilege. I believe what LogicLife said is very true as Immigration is a movement in life. If you don't believe, you probably don't deserve it when someone said you don't. I've been here for 12 whole years, got married and bought a house. I have been paying colleage tuition, taxes and my duties as an entity in this society. I deserve a green card.
