This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.

I never have and never will like the idea of being asked to pay, I give what I can unasked.
Unfortunately, the statistics paint a different picture of us "members" as a whole... and that's what needs to be addressed asap.
What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.Of course! And for those who genuinely cannot pay *the doors are STILL OPEN - prove your commitment by volunteering. Does that work for you? Or (in all seriousness, treat this as a question that needs to be answered) - are you simply looking for a forum/messageboard?
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?Of course not! And I hate that "being yelled at" as much as anybody else on this forum. Which is why the concept of paid membership. Nobody asks you how much you paid/contributed in every second post - isn't that what you really want???
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose. So basically all you want is some organization and members to do their work, while you come to the forums, vent your frustrations, pass your time, get some answers and opinions to your problems, and leave to tend to your "responsibilities" - because you have both financial obligations and time commitments that are completely unique, and you are the only person who is saddled with those - whereas everyone else leads a happy, prosperous life, with time and money to spare? Nice!

If this proposal forces you think what's IV really worth to you - regardless of whether you are actually motivated into contributing or volunteering or not - I will consider the time spent on this thread a great investment!
However, if all you think of IV is as a message board and a bunch of idiots trying to fix things that may never get fixed, and if they do - you'll always stand to gain - a membership-based organization would better serve the needs of the rest, imho.

I have done a lot of research on this topic and ended up in taking Tata-AIG. Few tips I can tell:
1. Try a high deductible: It brings down your rate significantly down. The way I saw it is, hopefully nothing will happen to my parents and for small things I have friends who can help them out. If there is something big I can afford a part of it and let insurance take care of rest.
2. have a few extra days than what your parents are coming for: say they are coming for 90 days get one for at least 120 days. Also make sure you get policies which are renewable.
3. Check on the insurance website if it covers hospitals in your area. I looked in one insurance where nearest hospital was 35 miles away from my home.
4. Look for ICU and surgical coverage closely as these two coverages are the most expensive and insurances tend to not cover it.

I believe you have to file an amendment to let USCIS know that you intend to continue on H1B after you return using AP OR file for an H1B extension if you are within that timeframe before a transfer.
AFAIK, when you return on AP, you are paroled into the US and the I-94 you get is valid only for the term of your AP. When you send that I94 copy across to USCIS for your H1B transfer, you may have an issue.
I believe this is just procedural since I have seen a lot of people continue working on their H1B for their current employer (Same as GC) after using AP and they have not had any issues.

If the visitor develops some symptom, it could be because of some condition that originated in his/her country and the symptoms showed up now. Note that in this case the insurance will treat it as a pre-existing condition and the claims will be denied.
Remember that insurance companies make the determination only after a claim is made and not before the visitor is taken to a doctor. So please be aware of all scenarios before buying an insurance.
My suggestion is to get a medical checkup done in the home country for any hidden condition, get it treated if you are buying just an emergency insurance or declare the condition and buy an insurance that covers pre-existing case. Be aware that depending on the condition the premium could be high or if the condition requires treatment the insurance could be denied..

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.
The vast majority of people are here on these forums for getting their GC and USC.

I know Aman has made a no. of trips to DC & these are not cheap.
Let us all contribute to pay back all his trips .
I am serious about it as people have no idea what people like Aman & others have done / sacrificed. If fact, we should authorize the Money Manager of IV to immediately release the entire amount Aman & others have spent since 19th December 2005.
I am sure IV must have funds to handle this... if not, atleast start a part payment each month immediately

One of the abuse is to avoid paying tax.Some big companies are sending L1 persons out of the country after they complete 11 months(If L1 persons are staying more than 1 year company has to pay tax). Now L1 and H1 are having same type of of nature of work but L1 has so much undue advantages like L2 can work, No salary restrictions, Companies can avoid taxes in many circumstances with no restrictions in rules like H1b at all. No cap also.This is also some type of discrimination in the law. In fact L1 need to be capped than H1b as L1 is playing more role in displacing USA workers but many cases in H1b is creating more jobs by innovation.

If it is pending for more than 2 yrs, what are the next steps?

Macaca, you are so right in asking those blunt questions but is that going to make a difference? I dont think so, your audience here is very thick skinned and will come up with all the BS in the world to not contribute.
I think we should not allow Leechers to start new threads. Conservation of resources should also be on the priority list when raising the money is such a difficult task.

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioner�s net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioner�s net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)
Ours is a small company and doesn't have net income or net assets matching the proffered wage.

I received a call from my lawyer last week saying he got a call from USCIS asking the lawyer whether my wife got the TB Skin test done or not, as she did not get it originally as we were expecting our child at the moment.
I sent the lawyer the scanned copy of the TB skin test results and posted him the sealed envelope separately yesterday, which he was planning on Faxing over to USCIS. Today I saw a soft LUD on my wife's I-485.
Don't know what this means? Its hard to belive that my Lawyer is so proactive to send the fax right away. And I can't believe that someone at USCIS actually updated my wifes case after lawyers response...
So don't know whats going on there... Friends whats meant by pre-adjudication?
