I agree with all you folks that we should not just be happy and end our fight here after getting EAD etc...
We should try to push it back to the government as why legal immigrants from india have only 9800 visa every year...its unjust for a country as big as india and havin so many hitech workers....
On todays 7/18/07 NPR news, a USCIS spokesperson has mentioned that USCIS has made a note of the recent protests by legal immigrants(flowers and rally)....NPR also has mentioned this website also....it is a big achievement for us and we should pursue till the final step...check out the link below.....

Can we have some kind of time line that IV core/lobbying firm has knowledge of about S .9 and what might or will happen in March, just in another 15 days.
If I call the IV number, can we get the future time line.
My GUESS is that, it would take same time (if not more) for S9 as it would take for the IRAQ issue in Senate and House.
I think if it wasn�t for the IRAQ fiasco we would have had our issues resolved a year back.
And the start of S9 won�t happen till IRAQ issue is resolved/voted/rejected in senate or house.
I think the biggest hurdle for S9 would be the request by Democrats to DUBYA to provide certain number of votes from Republicans. Democrats do not want to put there neck on the line for immigration issue. In other words if it comes to party line voting S9 is probably on the fence, and most likely to not pass.

GcSoon-Ihope is from France. I thought that retrogression is mainly for India with some effects on China, Philipines and Mexico.

It doen't matters where he is from France or any other other country. The truth of the matter is, this is what exactly happens to every HIGH SKILLED Legal immigrant in this country. Some may go thru less others more...but this is tragedy of the system created by the 'worthless and clueless politicians of USA'.

Hi Friends,
I checked my status and havent received any Soft LUD, but I received a FP notice couple of days back. I am not sure what this is for..My PD is Dec 2006 (EB3) and I received EAD/AP/I140 approved. I applied concurrently during the july fiasco and already done with FP on 2007 itself.
Now i am surprised why I need to , go for FP again. I am still in H1 and my EAD is expired and havent renewed.
Can anyone shed some light in to this FP notice ???

Just because a large number of IV members are EB2 Indians (based on the comments posted) doesn't mean that we should ignore the interest of EB3 ROW or EB3 Indian/Chinese.
Any talk about moving visa numbers from EB3-ROW to benefit EB2-India only divides us therefore should be despised. Let's focus on the real issue (supply & demand of EB visa in general) and serves the interest of all people suffering from this.
However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.

Cmon dude. We expect a better example to back up.
The example you state is a violation of anyone's civil rights...leave alone an immigrant.
No one is raping you by imposing a per-country limit on your green card application.
Congress used the power given to them by the Constitution to frame Immigration laws and they created a formula for regulation. Per-country limit is that formula which they had every right to create in order to uphold the balance of immigration in their country. Getting a GC is not anyone's right..its a privelege bestowed based on the applicant meeting certain criteria which includes quotas, as per the country's laws. There is NO civil rights impact. You are getting your green card in the end...only problem is they are making you wait 10 years because of that formula. But none of your civil rights are being impinged upon. So we should work to change flawed law rather than try to muddle the issue with civil rights. No matter what extreme example you give, you will still never be able to prove that your civil rights were impinged because you are having to wait for 10 years in a legal queue while your application is pending.
Don't get caught up trying to defend a stance no matter how irrelevant it may be. Its better we focus our time and effort on more achievable and valid provisions.

Very true. Also members should stay away from promoting one presidential candidate versus other. How does it help our cause? This has nothing to do with free speech. There are so many other websites for such discussions.
Though I agree wholeheartedly that this is not a platform for supporting any of the candidates in the Nov election, but given that more than 90% of the people who frequent this forum are not even citizens of the country and cannot vote... Even if I get hugely motivated towards any of the 2 candidates, by reading the motivational messages from other fellow posters, what can I really do ?

But from what I understand, a lot of people still don't know about IV and we must make more attempts to spread the word. Many people just don't know or understand the concept of IV. When we want them to join, the get suspecious and cautious and stay away. The idea here is to reach more and more people. IV is better organized now than what it was before and as people start to realise, they will come forward. Remember, IV is a concept and a platform andwill always stay. people may come and go - there will always be people motivated at different levels.

i graduated more than 10 years ago...with an Engineering degree...i know about the $100-200 merit seats...which were extremely difficult to get. I could have gotten the merit seat in a lower ranked college but chose a better college. It applies to only the top 5% or less of the total applicants. You don't get to the top 5% without spending a small fortune in private coaching ...why... because your regular teachers hardly make an attempt to teach you well...and they are the same ones who make lot more money in private coaching.
Anyways even with the very little $100-200 "almost impossible to get" merit seats there are plenty of other expenses for engineering. This is out of the question if your family is not in lower middle class economically atleast.
ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.

1. I was wondering how this rule would affect people like me. My labor has been approved and its been about 50 days. I will be applying for I-140 this week. Will this 45-day rule affect me?
2. If what is stated in immigrationportal about the labor substitution is true, then we don't have any real benefit from the this rule, because all labors certified before the implementation of this rule are not bound by the 45-days time constraint?!? All the so called desi companies may not sell the labors, but would not spend money to cancel it either. So those old labors are going waste as they are still active.
The cut-off date is determined by #485, not LC.

Not being judgmental at all. This is a question that has to be posed to the HR department in the company and not to 'peers' on a forum. The profile says he/she is on EB2 and then he/she goes on to ask this
"let me know if they have done EB2 with this scenario." WTF! :D While I'm not against getting your degree online or IGNOU but you need to at least have the acumen to geo-locate yourself it nothing else :D Other skills are far superlative and come much later :D

Any idea why it's important for the attorneys to notify USCIS that I'm no longer a H worker? The petition would expire next March anyway...
Its a USCIS regulation (8 CFR 214 2 (h) 11) that your employer/lawyers are following, which requires informing USCIS if you are no longer working in H1B status for any reason (got a GC, layoff etc):
(11) Revocation of approval of petition--
(i) General.
(A) The petitioner shall immediately notify the Service of any changes in the terms and conditions of employment of a beneficiary which may affect eligibility under section 101(a)(15)(H) of the Act and paragraph (h) of this section. An amended petition on Form I-129 should be filed when the petitioner continues to employ the beneficiary. If the petitioner no longer employs the beneficiary, the petitioner shall send a letter explaining the change(s) to the director who approved the petition.
