I think we should ask them something like "When it takes 7-10 yrs for a legal immigrant to get his green card, what would be your estimate for illegal immigrants to get their green card / citizenship when they are sent to the back of the line as per your plan? Don't you think that there are more serious issues with the immigration dept (USCIS) which is one of the causes for long waits legal immigrants face? If so do you have any plans of taking a first step to fix the agency (USCIS) problems before implementing CIR, which could break the agency because of the additional 13 million application from illegal immigrants?"

I have very high regards for Aman due to his dedicated efforts. 64K he spent is the big big amount as an individual.
I suggest, lets have a request to Bollywood artist to organize some shows at USA in benefit of IV (they may give us some discount). We shall pay back 63K to Aman (IV can keep 1k as his contribution).

Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.
We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.
I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.
Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.

I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.
1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.
2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.
And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!
RECAPTURE OF IMMIGRANT VISAS LOST TO BUREAUCRATIC DELAY.
(a) Worldwide Level of Employment-Based Immigrants- Subsection (d) of section 201 of the Immigration and Nationality Act (8 U.S.C. 1151) is amended to read as follows:

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!
Your situation confirms what I believe. They touched your file, because in the sequence of paper file receiving, your file is next. While issuing RFE, adjudicator did not even look at your PD or chargeability. When it is all clear, then perhaps they will open the page where PD and birth country are written. If at that moment in time your PD is current you will be cleared, else back to same (or some other) pending stack of files.
RFE could be for so many things, birth/medical certificates not acceptable, something is not properly signed, photos missing, passport photos not clear, etc.

The current discussion is in the House Judiciary Committee. After this, the major steps for the bill will be to go through the House and Senate for discussions and voting.
There is still a long way to go, but sure this is an important milestone to pass the Judiciary Committee.
And it might not even be possible to get it to the House before the Pres elections. But the good thing is it will not have to go through the Judiciary commitee again.
Just wanted to state it for the benefit of the people who are not aware, as we are not building hopes that it will be all over today or in the next few days.

Second the idea of using an ATM card for this purpose. You can get an ATM card for your parents or relatives in India from your local credit union or bank in the US.
ATM is a good idea.. What I normally do is I take or send my US check book signed of course and my name or family members name in pay to field.. No transfer fee or any thing and you can directly deposite it in any bank account with USD amount on it. The catch here is it take 10-15 business days.. but if it is not an emergency I find this is the best way and besides this you get better rate too...

I will continue to contribute to IV even I get my GC in few months (highly unlikely) until the goals of IV are met. Also salutations and big thanks to the spouses and families of IV core. Their contribution and sacrifice is unsung, but in my opinion their sacrifice of their loved ones time and spending all savings for good cause is remarkable in itself. A big applause to the families of IV core for being so understanding.

I know how it feels when guys out there with priority date later than you get approved and you're stuck in this black hole with no clue on what the current status is.
Usually, it takes atleast 7 days for the congressman staff to get any response. It's always better to call the staff casually after couple of days to make sure they have got all the paper work you've sent and they are working on it.
I'm sure your case will be approved soon - have hope.

what if Obama does not win :) ..if something has to pass it will pass during this term. things and priorities change after a person gets elected. this is politics 101. I appreciate your optimism and if there is no spill over then EB3-I faces the worst case scenario. as usual the truth is somewhere in between. i.e. be ready for a long road ..if you get before that ..then good.

It doesn't matter what the president wants to do as far as CIR is concerned. As far as CIR is concerned, George W begged it to be passed in both houses well before he became a lame duck. I don't see how the lawmakers on far right can come and align with the far left or even the lawmakers who are in the center. For the CIR to pass through without issues, Dems should control both houses with a big majority. Also, if you are thinking that Obama is going to win this, you are very well underestimating Mac. watch out for the GOP machine in the last 2 months and it will be a different ball game. Clinton lost because her campaign was over confident and by the time they realized they had a string of 10 bad states whose background does not suit her. Mac's campaign can't be over confident after they saw what happened. GOP is going to do its best to further divide the badly bruised Democratic party. Its few states that will decide this election and its difficult to carry states winning only the metropolitan areas. Obama won 5 counties of 90 some counties in OH. If his performance in general election is going to be the same, forget OH. Same situation in WV.
For now, I feel Obama is a great visionary and ideologue. No one knows whether he will achieve most of the things he is promising to do if he becomes the president. But he has been very logical and rational esp with the gas tax holiday. All said, he looks like a destiny's child. Imagine where he would have been if the Rev wright wreck came before the Iowa caucuses.
There are so many ifs and buts. our interests are best served with out the big vehicle CIR. If thats the only vehicle, we possibly are going to be held hostage.
as others mentioned ..the only other thing you can do is support IV.

I follow politics too and politics is very complex for mortals like us. there are many obstacles for Obama ..his tax policies, some of the controversies and mr Rezko ..why do you think Clinton only suspended her campaign but did not close it completely ?

It doesn't matter what the president wants to do as far as CIR is concerned. As far as CIR is concerned, George W begged it to be passed in both houses well before he became a lame duck. I don't see how the lawmakers on far right can come and align with the far left or even the lawmakers who are in the center. For the CIR to pass through without issues, Dems should control both houses with a big majority. Also, if you are thinking that Obama is going to win this, you are very well underestimating Mac. watch out for the GOP machine in the last 2 months and it will be a different ball game. My I-140 got approved even though my company also did not file 2006 Tax return. My company is a small(less than 30 employee) loss making company. Our company secretary just gave a letter that company has not filed tax return for 2006 and has asked for extension, attached request for extension. If you are meeting any one of the three criteria of the yates memo, there are very high chances of I-140 getting appoved. Search for yates memo and you will get more details. Is your current wages more than prevailing wages? If yes, then you will be fine. Your lawyer has do a very good analysis of companies ability to pay prevailing wages. So work with your lawyer and you will be fine.

My PERM application (5/28/07 PD) stuck at Atlanta
In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....
me...really sad....
